On November 8, Nguyen Hai Nam (46 years old) and Lam Hoang Tung (29 years old, former lecturers of the Ho Chi Minh City Procuracy Training School) were appealed by the High People’s Court in Ho Chi Minh City and considered the petition. unjustly guilty Violation of another’s residence.

Having served the penalty according to the first-instance judgment, the defendants were released on bail to participate in the trial.

Meanwhile, victim Hoang Thi Thu Thao appealed to increase the punishment for the defendants and said that the first-instance level overlooked the crime. Just like in the trial of the first instance court, this woman asked to be absent.

Defendant Tung had 6 defense lawyers, but one was absent. The jury thought that this did not affect the rights of the accused, so the trial continued.

The first-instance judgment determined that Tung said he had pooled money to buy a house at 29 Nguyen Binh Khiem (District 1) with Hoang Trong Anh Chi, but let her name it. After that, Chi sold the house to Ms. Hoang Thi Thu Thao, received a deposit of 7 billion dong, but had not yet transferred the name. During the performance of the contract, both had conflicts because Ms. Thao built the project illegally and was suspended by the Department of Construction.

On the afternoon of September 19, 2019, Tung led people to make a living by taking back the house “to make the right construction permit”. Because Thao’s family refused to take the 3 children out, Tung, Nam and Nguyen Thi Huong Tam carried the children and took them to a taxi to deliver to Thao.

During the investigation and trial, Nam and Tung both complained. Related to the case, Nguyen Thi Huong Tam has fled and is wanted.

Tung believes that only the owner of the house, or an authorized person, has the right to legal accommodation. Currently, the house is still in Ms. Chi’s name, Tung is authorized to take it back, so it is not a crime like prosecution.

As for Mr. Nam, on the afternoon of the incident, Tung called, saying “there are 3 tenants coming to disturb”, asking for help. When he heard the news, he called the Chief of Police of Da Kao ward, district 1. When he arrived, he saw the police, civil defense and even the bailiff there… so he couldn’t take any action. At the end of last year, the People’s Court of Ho Chi Minh City at first instance sentenced the defendant Nam to 1 year and 5 months in prison, and Lam Hoang Tung to 2 years in prison.

Knowing that Mrs. Thao has a house on Nguyen Trai Street, he went to 29 Nguyen Binh Khiem’s ​​house to take her children to the house above and give it to her mother. “At this time, there were many women in front of the house screaming, demanding to ‘return my children’, but when they took the children out, no one reached out to pick them up,” defendant Tung said.

Similarly, defendant Nam also kept the same testimony as before, saying that on the day of the incident, he went to 29 Nguyen Binh Khiem’s ​​house but stood outside. “Seeing the children were struggling and no one was holding them, I helped them again,” the former deputy judge said.
