The other three defendants are Vo Hong Cuong, chairman of the Board of Directors and director of the Hung Vuong Joint Stock Company, Nguyen Thuc Anh, former chairman of the Board of Directors of Development Company Limited, and Tran Dinh Nhu Y, Chairman of the Board of Directors of Development Limited Liability Company.

According to the conclusion of the additional investigation, Mr. Nguyen Van Minh, former Chairman of the Board of Directors and General Director of 3-2 Corporation, together with his son-in-law Nguyen Dai Duong and his accomplices committed acts that intentionally contradict the content approved Approved by the Binh Duong Provincial Party Committee to illegally transferred an area of ​​43 ha to the Au Lac Company founded and operated by Nguyen Dai Duong. The value of the right to use 43 hectares of land in the Hoa Phu area (Thu Dau Mot town, Binh Duong) at the time of the transfer was more than VND 552 billion, causing the State loss of nearly VND 202 billion (the transfer price was more than VND 250 billion). ).

Simultaneously, the Defendant Nguyen Van Minh ordered the Members of the Council to include a land area of ​​145 hectares into the area of ​​equity participation with other companies without conducting an assessment, not including in determining the value of the company, which caused the loss of state assets amounting to more than 1.648 billion VND. In total, the actions of the accused Nguyen Van Minh and his accomplices in the case caused state losses of more than VND 1.850 billion.

Regarding the act of embezzlement, with the aim of creating a source of money to repay previously used, Nguyen Van Minh created the conditions for the Development Company founded by his daughters Nguyen Thuc Anh and Tran Dinh Nhu Y to repay the Bank’s debts when contributing capital to the Tan Thanh Company, and on at the same time creating conditions for Hung Vuong Company to have the financial resources to pay the amount owed to Company 3-2. Utilizing his position and authority as Chairman of the Board of Directors of 3-2 Corporation, Nguyen Van Minh issued a policy, decided and directed the valuation of the land use rights of 145 ha to create a difference in value compared to the land value when included in the capital contribution in Tan Thanh Company, bought, sold and transferred 19% shares to take over 815 billion VND from 3-2 Corporation.

Thus, Nguyen Van Minh occupies more than 154 billion VND; Nguyen Thuc Anh has more than 209 billion VND; Tran Dinh Nhu Y has more than 201 billion VND; Vo Hong Cuong has nearly 39 billion VND…

For Mr. Tran Van Nam, the conclusions expressed during his tenure as Deputy Chairman of the People’s Committee of Binh Duong Province, signed and promulgated Official Letter No. 3444/UBND-KTN dated November 23, 2012 approved the land price for the service area in the Complex to be 51,914 VND/m2 (the average land price issued in 2006) for the Tax Department to calculate land use levies for 43 ha and 145 ha of assigned land for 3-2 Corporation in 2012, 2013, contrary to law , was the direct cause that led to the loss of the total state budget of more than 761 billion VND.

In dealing with 43 ha of 3-2 Corporations land, with the prescribed authority, Mr Tran Van Nam can fully take the decision to force 3-2 Corporations to deal with the consequences by properly implementing the rules. law. However, due to personal motives, defendant Tran Van Nam decided to intentionally let 3-2 Corporation continue to carry out further illegal acts, without asking to bring the 43 hectares of land to the public. Company Impco in accordance with the approved Land Use Plan. In order to legitimize and conceal wrongdoing, Tran Van Nam continues to direct his subordinates to “legalize” official documents that falsify the detailed consent nature of the owner’s land use plan. The behavior of the accused Tran Van Nam has caused state losses of nearly 202 billion VND.

“As the person with the highest position among the defendants, who committed this crime and took advantage of that position and authority to commit the crime, the crimes committed by defendant Tran Van Nam are very serious; the application of ground pressure to collect land using a levy which is against the regulations, led to the low cost of land allocated to 3-2 Corporations, which is one of the causes of the crime”- Conclusion of the investigation.
