Past the time limit to fix, Cuong’s underground construction project ‘dollar’ has not yet been licensed

Regarding the case that C-Holdings Joint Stock Company built without permission at the C-River View project (Phu Tho Ward, Thu Dau Mot City, Binh Duong Province), on the afternoon of March 15, Mr. Huynh Pham Tuan Anh – Deputy Director of Binh Duong Department of Construction confirmed that up to now, the investor has not been granted a license construction permit.

According to Mr. Tuan Anh, C-Hodings Joint Stock Company has submitted an application for a construction permit of the C-River View project to the Department of Construction and its specialized department under consideration. If the dossier is valid, the specialized department will advise and submit it to the leader in charge of the field for settlement.

The investor of the C-River View project has been fined twice for illegal construction.

Before that, on the morning of March 15, discussed with PV VietNamNetMr. Le Huu Nhon – Chief Inspector of Binh Duong Department of Construction said that C-Holdings Joint Stock Company had paid a fine of VND 50 million. However, with the contents of this enterprise’s application for a project construction permit, Mr. Nhon did not answer.

C-Holdings Joint Stock Company is the investor of Phu Tho Quoc Cuong Apartment Project (trade name is C-River View). The legal representative of this business is Mr. Nguyen Quoc Cuong, also known as Cuong “dollar”.

Inspector of Binh Duong Department of Construction has twice issued a decision sanction administrative violations against C-Holdings Joint Stock Company on the act of organizing the construction of works without a permit at the C-River View project.

Specifically, on February 9, 2021, the Inspector of Binh Duong Department of Construction issued a decision to sanction the investor of the C-River View project with an amount of 40 million VND for illegal construction. The illegal construction items include: Block A and Block B, the project of mass pressing 361 piles; drill 79 bored piles and 5 experimental piles.

The sanctioning decision clearly states that, if after 60 days from February 5, 2021, the investor fails to present the construction permit, the measure of dismantling the offending work will be applied.

However, at the end of this time limit, C-Holdings Joint Stock Company not only did not carry out the procedures to apply for a construction permit, but also continued to organize the construction of the work without permission.

By January 2022, the items at the C-River View project were built underground by the investor, including: Basement building area 5,051.3m2; 1st floor building area of ​​4,963.62m2; 2nd floor has concrete columns, beams, reinforced concrete floors with an area of ​​1,099.04m2; 3rd floor has concrete columns, beams, floors with an area of ​​643.12m2.

The C-River View project is currently suspended from construction.

With the recidivism of illegal construction at the above project, on January 10, 2022, C-Holdings Joint Stock Company was issued an administrative sanction by the Inspector of Binh Duong Department of Construction with aggravating circumstances.

In addition to the fine of VND 50 million, the Inspector of Binh Duong Department of Construction asked the investor of the C-River View project to complete procedures to request the competent authority to issue a construction permit. The time limit for implementing remedial measures is 60 days from January 11, 2022.

Up to now, the deadline for C-Holdings Joint Stock Company to implement remedial measures at the C-River View project has expired, but this enterprise has not yet been granted a project construction permit.

For C-Holdings Joint Stock Company to repeat illegal construction, a leader of Binh Duong Department of Construction said that there was a loose management of the Inspector of the Department of Construction. Although the C-River View project has been built without permission to the 3rd floor for more than a year, recently, on February 28, 2022, the People’s Committee of Binh Duong province has decided to allow C-Holdings Joint Stock Company to change the use purpose. use land area of ​​5,607.4m2 to implement the project.

Accordingly, the People’s Committee of Binh Duong province allows the investor of the C-River View project to transfer 3,317.4m2 to non-agricultural land and change the land use purpose with a variable registration form with an area of ​​2,290m2 of residential land.
