The relationship between Nguyen Dai Duong and the female tycoon in the 43 hectare ‘golden land’ case

The conclusion of the additional investigation revealed the relationship between the once famous NewCentury disco owner and the giant woman in the case of 43 hectares of land in Binh Duong being illegally transferred.

The Investment Police Agency of the Ministry of Public Security has just completed the conclusion of an additional investigation into the case of property embezzlement, violation of regulations on management and use of state assets, causing loss and waste at the Manufacturing Corporation- import and export Binh Duong One Member Limited Liability Company and related units.

This additional investigation conclusion proposes to prosecute 28 defendants for crimes of violating regulations on management and use of State assets, causing loss, waste and embezzlement of property.

Among the defendants proposed to be prosecuted are Mr. Nguyen Van Minh (former Chairman of the Board of Directors and General Director of 3/2 Corporation) along with his son-in-law Nguyen Dai Duong and Mr. Tran Van Nam (former Secretary of Binh Duong Provincial Party Committee).

Nguyen Dai Duong was once famous as the owner of the NewCentury discotheque in Hanoi.

In June 1988, Nguyen Dai Duong was arrested for the crime of trafficking in prohibited goods. Regarding the New Century disco case, in August 2007, Duong was prosecuted for the crime of harboring illegal drug use.

On December 29, 2009, the Hanoi People’s Court held an appellate trial against Nguyen Dai Duong and exempted him from criminal prosecution.

Returning to the conclusion of the additional investigation, the CQDT said that in August 12, 2016, Mr. Nguyen Van Minh – representative of 3/2 Corporation signed a contract to transfer the 43ha land area to Tan Phu Company for more than VND 250 billion, although at that time, Binh Duong Provincial Party Committee directed to hand over to Impco Company.

The Property Valuation Council in the criminal proceedings of Binh Duong province has concluded that the property valuation, determining the value of the land use right of 43 hectares at the time of December 2016 is more than VND 552 billion.

At the time of prosecution of the case (December 2019), the conclusion of the property assessment determined that the 43-hectare land was worth more than 1,335 billion VND.

According to the conclusion of the additional investigation, the transfer of the 43-hectare land to Tan Phu Company was contrary to the approval of the provincial Party Committee, contrary to the provisions of law, and the transfer of 30% of the contributed capital at Tan Phu Company to the Tan Phu Company. Au Lac Company caused the State to lose all ownership rights in the above land.

The behavior of Mr. Nguyen Van Minh, his son-in-law Nguyen Dai Duong and his accomplices caused damage to the State more than VND 201 billion.

The mastermind of negotiating the sale of “golden land”

According to the testimony of Nguyen Dai Duong, around June 2010, he was told by his father-in-law that 3/2 Corporation had land plots in Binh Duong new city, good investment and needed someone to cooperate with investment. .

On that basis, Duong re-introduced Nguyen Quoc Hung (General Director of Au Lac Real Estate Joint Stock Company) and brought Mr. Hung to meet and discuss specifically with his father-in-law.

Nguyen Dai Duong also introduced Mr. Huynh Trung Nam and Duong Dinh Tam to contribute capital to establish Au Lac Company in order to have a legal entity sign an investment contract with 3/2 Corporation, establish a joint venture company Tan Binh Duong. Phu to implement the project on a land of 43 hectares, through the form of buying all contributed capital at Tan Phu Company (project investor).

After Au Lac Company and Thuan Loi Company (appointed by Ms. Dang Thi Kim Oanh, Director of Kim Oanh Investment and Development Company in Ho Chi Minh City) signed a contract to promise to buy and sell 100% of contributed capital in the Company. Tan Phu Company for 350 billion VND, Duong stood up to receive 20 billion VND deposit from Thuan Loi Company and received a total of 220 billion VND transferred by Au Lac Company to his account…

Duong Khai, in addition to the above relationship, between the accused and Ms. Kim Oanh also has a relationship of borrowing and borrowing money from each other.

Defendant Nguyen Dai Duong did not acknowledge the contribution of capital to Au Lac Company, but only recorded as an introducer and “legal consultant” for Au Lac Company in its relationship with 3/2 Corporation and the Company. Thuan Loi, but not operating Au Lac Company.

However, the additional investigation conclusion said that Nguyen Quoc Hung and Ms. Dang Thi Kim Oanh and other related people all declared Duong as the main person in the relationship with Thuan Loi Company, because Duong was the negotiated with Ms. Kim Oanh, received a deposit from Thuan Loi Company and received most of the money paid by Ms. Kim Oanh to Au Lac Company through Hung.

For her part, Ms. Dang Thi Kim Oanh admitted that around June 2016, Duong called to introduce and suggest her to buy a 43-hectare project in Binh Duong New City.

Ms. Kim Oanh agreed, so Duong gave the project legal documents to Oanh to see for inspection. After that, Duong introduced her to Nguyen Quoc Hung to discuss.

Although Duong introduced Hung as the Project Owner, Duong was the main negotiator with Ms. Kim Oanh.
