After the accident, Quy Hop District Police issued a decision to criminally arrest truck driver Bui Van Huy (SN 1991, resident in Dong Hop commune) to investigate and clarify the incident.
The truck lost control and drove freely across the highway and crashed into a store. The excavator on the back of the barrel flipped over to the death of a man.
Regarding this case, talking to PV, Doctor, Lawyer Nguyen Trong Hai – Director of law firm Trong Hai & Associates (Nghe An Bar Association) said that the criminal handling of the driver truck also depends on the investigation results of the competent authority.
Accordingly, if the cause of the accident is the driver’s fault from a violation of the Road Traffic Law, the truck driver may be criminally responsible for “Crime of violating road traffic regulations according to the law on road traffic.” Article 260 of the Penal Code 2015 (amended in 2017)”.

In addition to criminal liability, the truck driver also has a civil liability that is to compensate for damage outside the contract for damage to people and property caused by the accident according to the provisions of Article 584 of the Ministry of Transport. civil law 2015.
In case the accident is not caused by the fault of the victim, is not under force majeure or emergency situations, the driver is responsible for compensating for damage when causing the accident.
Regarding the behavior of the driver jumping out of the truck when the vehicle lost control or brake, Lawyer Hai added that if the driver was experienced and quick-witted, the tragic accident might not have happened.
“It is worth mentioning that in this tragic accident, fatal consequences could not have happened if the driver had been more clever, agile and calm. Thereby showing that driving skills and handling situations in unexpected incidents of motor vehicles are very important“, Lawyer Hai shared.

“If this driver had been quick-witted when the truck lost control of the vehicle and crashed into the fence or into the bushes on the side of the road, this unfortunate accident would not have happened. Maybe the driver was panic, inexperienced, not familiar with the car, so he jumped out of the car when there was an accident“, a resident in Dong Hop commune who lives next to the accident scene shared.
Earlier on the morning of March 13, Bui Van Huy (SN 1991, residing in Dong Hop commune) took the wheel for an acquaintance of a truck carrying BKS 14C-077.83 that was carrying the back of the excavator to go to work.
On the way from Hop Thuan hamlet to Highway 48A, this truck suddenly lost its brakes and lost control. Frightened, driver Huy jumped out of the car. The car continued to drive on its own for about 100m, crossed Highway 48A and then crashed into a house that is a store selling animal feed.
The excavator on the truck was not properly anchored and overturned from the trunk, hitting Mr. Tran Quoc T. (SN 1951, resident of Dong Hop commune) died.
It is known that victim T. is the Vice Chairman of the commune’s elderly association. After the incident, the local government visited and coordinated with the family to carry out the burial ceremony for the victim.
Currently, the cause of this accident is still continuing to be investigated and clarified by the Quy Hop District Police to handle in accordance with the law.
