Responding to voters, the Ministry of Construction said that the above-mentioned legal provisions on the management and use of apartment buildings were relatively complete, creating a legal corridor to regulate most activities related to apartment management. management, operation and use of apartment buildings such as: regulations on handing over apartment building documents; organize the apartment building conference; establishment and recognition of the Board of Directors; service charge for management and operation of the apartment building; parking space in the apartment building, management and use of funds for maintenance of the apartment building; government responsibility…

In 2021, the Ministry of Construction has issued Directive No. 02 on strengthening the management and use of funds for maintenance of shared ownership of the apartment building, and has conducted inspections for many investors. Management boards in some localities.

The Ministry of Construction has issued 18 inspection conclusions to 18 investors and 17 management boards at 24 apartment buildings/apartment clusters, forcing 12/18 investors to deposit maintenance funds into their accounts. according to regulations and settlement to immediately transfer to the Management Board of the apartment building with a total maintenance cost of nearly 345 billion dong, forcing 5/18 investors to return 2,080 m2 of encroached area to residents (with a value of worth about 62 billion VND).

At the same time, the Ministry has sanctioned 8/18 investors for administrative violations, totaling VND 1.03 billion.

In 2022, the Ministry of Construction will continue to issue an inspection plan No. 1258/QD-BXD, which will carry out a large-scale thematic inspection on the management and use of funds for maintenance of the shared house. apartments in 11 provinces and cities: Hanoi, Ho Chi Minh City, Da Nang, Bac Giang, Hai Duong, Hai Phong, Quang Ninh, Ninh Binh, Binh Duong, Ba Ria Vung Tau and Long An.

The leader of the Ministry of Construction added that, at present, the Ministry of Construction has assessed and summarized the implementation of the provisions of the Housing Law 2014 including the implementation of regulations related to the management of housing. , use an apartment building and have submitted a report to the Government on the application for the development of the Housing Law (amended).

Currently, the Ministry of Construction together with relevant ministries and branches continue to take steps according to the provisions of the Law on the Promulgation of Legal Documents to report to the National Assembly for consideration and approval of the Resolution to put the Law on Promulgation. Housing (amended) into the Program on building Laws and Ordinances in 2022 at the 3rd session (May 2022) of the XV National Assembly.
