Currently, a number of commercial housing and urban development projects with a land use scale from 2 ha to less than 10 ha are approved for investment in the period from the date of Decree 188/2013/ND-CP. valid until the effective date of Decree 49/2021/ND-CP dated April 1, 2021, proposing to adjust and extend the project implementation time limit (without changing the project’s objectives and planning expenditures) , is it “retroactive” when adjusting investment approval under the Investment Law according to Decree No. 49/2021/ND-CP?

Therefore, the Department recommends allowing the above case to remain in the form of social housing regulation according to the original approval or to choose one of three forms: directly spend 20% of the residential land fund in the project for investment. construction of social housing; transfer the housing fund equivalent to the value of the land fund 20% or pay in cash equivalent to the value of the land fund 20% at the price at which the investor fulfills the obligation to the State to fulfill the social housing obligation.

As for the certification of fulfillment of social housing obligations, currently the decrees only stipulate the form of performing the obligation to regulate social housing and do not stipulate the authority to certify the investor. have fulfilled the social housing obligation and the process and procedures for certifying the fulfillment of the social housing obligation.

Determining the cost of technical infrastructure investment and the cost of compensation for site clearance to pay investors when handing over 20% of the land fund in the project is also problematic. According to the Department of Construction, since the project is allocated land, the work of compensation for site clearance takes many years to complete. many households that do not receive money have to use land exchange, so determining the cost of compensation for site clearance will be very complicated.

Ho Chi Minh City has proposed the Ministry of Construction to provide specific guidance on how to determine the cost of site clearance compensation, infrastructure investment costs, and allocate these costs to the land fund for social housing construction. The agency in charge of appraisal and approval of the above expenses to refund to investors; payment to the investor when handing over the land fund for social housing construction to the State for project implementation.
