Cassava Association ‘begs’ Prime Minister for tax refund

The Cassava Association proposed to the Prime Minister to consider and direct the General Department of Taxation to stop the regulation of “verifying foreign customers when returning taxes”.

Therefore, the association proposed to the Prime Minister to direct the Ministry of Finance and the General Department of Taxes to return taxes in accordance with current laws and actual records of companies, ensuring objectivity and fairness in tax law enforcement with cassava exporters.

This recommendation was made after the General Department of Taxes issued Official Letter 632, which states that there are still situations of fraudulent tax return records from businesses for profit. According to this agency, in cases with the results of the determination by the foreign tax authorities (the import unit does not exist or does not exist but does not admit to importing Vietnamese goods), the tax department will confirm tax fraud. In this case, the General Department asked the local authorities to collect the files and transfer them to the police for handling.

According to the Cassava Association, these shipments are causing difficulties for businesses. Because the current VAT refund law does not stipulate that a tax return document must be certified by a foreign customer to qualify for a refund. The exporting company also has no obligation and capacity to verify foreign partners when signing contracts.

“The cassava industry is facing great difficulties and may actually collapse when the General Department of Taxation requires the implementation of the official delivery of these value-added tax returns,” said Nguyen Van Lang, Chairman of the Vietnam Cassava Association.

The association also mentioned that Vietnamese companies compete fiercely in exports with Thailand and Indonesia. If the VAT refund issue is not resolved in a timely manner, it could lead to the collapse of the multibillion dollar crop production chain and affect other industries with border exports similar to the cassava industry.

Previously, on 19 August 2021 and 27 January 2021, the Government Office sent two official messages to the Ministry of Finance to convey opinions to Prime Minister Pham Minh Chinh and Deputy Prime Minister Le Minh Khai on eliminating the issue of eliminating the VAT refund procedure. for cassava exporters.

The Cassava Association said that until now the problem had not been resolved, but it became more difficult when the Directorate General of Taxes issued Official Letter 632, if this departure was carried out, the business in the cassava industry would go bankrupt.

According to this association, cassava is the third most important food crop in Vietnam after rice and maize. The annual planting area is about 530,000 ha and is grown mainly in difficult mountainous areas. The number of employees in the cassava industry is more than 1.2 million people. In recent years, the export turnover of cassava and cassava products has reached 1.35 billion USD per year, ranking second in the world after Thailand.
