Illegal use causing damage must compensate for damage according to the provisions of law.
In case of using other people’s information and images without the consent of the person with the image information, they must be removed. If causing damage, they must pay compensation. If sued, they may be subject to legal sanctions. the law.
Illegal use of other people’s personal information may result in an administrative fine of up to VND 60 million according to Decree 14/2022/ND-CP.
Lawyer Cuong said that individuals have rights to their own images, their rights are expressed such as: Individuals can directly use images, promote their own images, publish, publicize images for the legitimate purposes of individuals… or individuals have the right to allow or not allow others to use their images.
When you want to use someone else’s image, you must get that person’s consent.
The law stipulates that in some specific cases, it is possible to use other people’s personal photos without permission.
Specifically, according to Clause 2, Article 32 of the 2015 Civil Code, it stipulates:
“The use of images in the following cases does not require the consent of the person having the image or their legal representative:
a) The image is used for the national interest, the nation, or the public interest;
b) Images are used from public activities, including conferences, seminars, sports competitions, art performances and other public activities without damaging honor and dignity. , the reputation of the person with the image”.
Thus, the case of using other people’s personal images for the common interests of the country, the nation, or the community does not require permission. In addition, the image obtained from public activities such as conferences, seminars, sports competitions, public art performances and other public activities without damaging the honor, dignity and prestige of the person. If there are images, everyone is allowed to use them.
Images that other people have published on social networks, in public, others also have the right to use and refer but not to damage their honor and reputation. The use of images of other people to insult the honor, dignity, reputation of others or use them for illegal purposes will be administratively sanctioned or examined for penal liability.

Currently, some people are spreading the news that there is a sex clip of a famous singer in their hands. If there is a real clip that is posted on social networks, this person will be criminally prosecuted according to Article 326, because the number of people to reach will be over 10 people.
