It is difficult for the regions to handle work that is waiting for compensation

No landmark ground clearance, low sanctions, people build houses at night… making it difficult for local residents to handle construction work awaiting compensation.

The North-South Northeast Highway passes through Ha Tinh with three component projects including: Bai Vot – Ham Nghi, Ham Nghi – Vung Ang and Vung Ang – Bung. Where, the Bai Vot – Ham Nghi project will pass through the Can Loc district.

Nguyen Tien Dung, Deputy Chief of Can Loc District, analyzed that according to regulations, land in the project must not change the status quo. Forests and agricultural land may not establish permanent jobs. However, many people lack awareness, listen to invitations, think that they will benefit, so they arbitrarily build illegal houses on the land of the North-South toll road project. There are also some people who “deliberately don’t understand” to serve their own calculations.

Mr Dung was quoted as saying, on March 17, the district set a record for the family of Ms. Le Thi Dien, who lives in the commune of Trung Loc, to build a permanent house on the land of the highway project. When he found out that Ms. Dien had poured soil to build the foundation of the house, district officials came down to take notes, but the family didn’t send someone to sign, only stopped construction. In the following days, they secretly built construction at night. After completing the construction of the nearly 2m wall, this household stopped as the commune continued to take notes, indicating that if violations were repeated, they would be dealt with more severely.

When asked to work, Ms. Dien gave many reasons for refusing, sometimes reporting that she was busy with personal matters and did not want to cooperate. At one point, he said that “this project is only visible on paper, no one has ever returned to risk the handover of the landmark. If the landmark was installed, I would believe it and carry it out, but now build a house to live in”. The entire Bai Vot – Ham Nghi route is more than 19 km long, but only a few hundred meters have been planted in the first section bordering the Duc Tho district, expected to be put into use by the end of November 2022, when site clean-up is complete.

The Can Loc district has established a site cleaning council, divided into three groups, each group has 5-6 district officials in charge, and cooperates with the commune with land for the highway to carry out tasks. However, Pak Dung said that the North-South Toll Road is a large project with hundreds of hectares of land to be treated. For some grassroots officials, this was the first time they had approached such a large volume of work, lacked experience in handling situations related to land acquisition, and even felt embarrassed at times.

Camcorder and drone investments were recognized by Can Loc district leaders as effective in monitoring and recording the status quo before and after landmark plantings as a basis for compensation, but not in the private investment category. Therefore, when any household takes the risk, the cross-cutting commune and district delegates just come to keep spreading and use cell phones to record videos for later reference. But often the device has problems, the video or audio is not clear, so processing becomes difficult.

One issue that worries Can Loc district leaders is sanctions. Households violating construction on the project site will be fined 5-10 million VND, stop construction and restore the site. This amount is not enough to make a deterrent, making some cases willing to violate, because the amount of compensation if enjoyed can be tens of times.

“Land acquisition projects take many forms. In many cases, there is conflict within the family, where the wife agrees on the compensation price, but the husband does not, and the staff takes days to advise the two. I have to persist in analyzing, spreading and persuading,” said Dung.

The North-South Northeast Expressway passes through Vinh Ha Commune, Vinh Linh District, Quang Tri Province. Currently, neither the communes nor the districts have received the handover of ground clearance landmarks in the field, and there are no legal documents on planning and land acquisition. It was difficult for commune officials to explain to people when asking to stop work. “People ask for documents showing the highway passing through the land, but we don’t have them. They say they built huts to guard the park, so they can’t stop it,” said Nguyen Van Thao, head of the Vinh Ha commune.

According to Mr Thao, the fact that people plant trees and build small granaries on their garden lands for economic development cannot be prevented by the commune. If people are forbidden to cultivate and build works, if they don’t cross the highway, “the commune doesn’t know how to explain it”. In fact, many people hide and do not cooperate when they see the working group. Some of the construction owners live in other areas, so when the authorities come to deal with them, they can only meet with the masons. The delegation of the commune also only worked during the day, while the people built at night and on rest days.

Vinh Ha Commune has recorded 23 households expanding barns on residential land, agricultural land and planting trees in the project survey area. Mr. Thao explained that this handling under the law on land, agricultural land, forestry is not allowed to build work. Sanctions cannot be carried out, but only stop at making minutes, asking the community to stop construction.

The North-South Northeast Highway Project, Ha Tinh – Quang Tri section, is 267 km long. In addition to the three projects in Ha Tinh, the section that passes through Quang Binh province has three projects: Vung Ang – Bung, Bung – Van Ninh and Van Ninh – Cam Lo, the section that passes through Quang Tri province has Van Ninh – Cam Lo projects. From early March until now, in the three provinces of Ha Tinh, Quang Binh, and Quang Tri, people have rushed to build emergency work and plant trees to await compensation on the planned section of the highway.
