Accordingly, the Chairman of the City People’s Committee asked the branch of the city’s land registration office to suspend the separation of agricultural land plots in the area from March 22 until there are new instructions.

Specifically, suspending the procedures for the separation of plots for agricultural land plots not adjacent to roads. For land plots adjacent to roads, the division of land parcels shall be temporarily suspended for land plots with a minimum area of ​​less than 2,000 m2 for wards and under 3,000 m2 for 2 communes Tan Thanh and Tien Hung (including land plots). separated and the remaining parcel of land; a parcel of land is split only once, not further from the separated plot).

Many plots of land are just for buying and selling to make a profit, not exploiting anything on the land, creating a “virtual land fever” with many potential risks for the planning and economic development of the locality.

According to real estate experts, the division of agricultural land parcels and parcels causes consequences such as the increase in local land prices, the retention of that type of land causing difficulties for investment activities in real estate projects. The real estate market is chaotic, people’s homes buy land and collect land.

A series of localities have strongly “tightened” plots for sale, many real estate brokers believe that this regulation will cause the land market to “stop”, transactions may be quieter. Sharing at a recent scientific conference held by the Vietnam Institute of Economics related to the revised Land Law, about to be submitted to the National Assembly at the 3rd session (opening in May), Prof. Dang Hung Vo, former Deputy Minister of Natural Resources and Environment, said the drafting agency has mentioned four times the goal of amending the Land Law. But only a few years later, the regulation was more open, allowing subdivision for sale in town and countryside. Until the Land Law 2013, it was allowed to divide plots for sale in the city center.

“This is not reasonable, so the mechanism of dividing plots for sale of plots must be abandoned. The first fever land is in the ground land, then in other types of land”, Prof. Hung Vo said.

According to Mr. Le Hoang Chau – Chairman of Ho Chi Minh City Real Estate Association (HoREA), the Land Law 2003 and 2013 do not stipulate the separation of agricultural land plots or the separation of other types of land other than land. live. But, in Decree 43, the Provincial People’s Committee stipulates the minimum area allowed to separate the parcel for each type of land to suit the specific conditions of the locality.

This regulation has allowed the separation of parcels for each type of land, which can be understood as allowing the separation of plots for agricultural land, forestry land, non-agricultural land… tycoonspeculators take advantage of rampant splitting of plots and turning them into residential land, disrupting urban development planning.

Therefore, HoREA proposes to the Government to consider and abolish this regulation because it is not in accordance with the land law and may lead to the consequences of increasing the situation of widespread division and separation of parcels, difficult to control.

Regarding land prices, real estate experts said that most of the land in legal projects is high, there are no projects with low prices, so there is no fear that the temporary halt in the separation of agricultural land will make residential land prices worse. If the project increases in price because the price increases, the liquidity will be slower.
