From April 1, 2022, discount tax environmental protection 2,000 VND/liter of gasoline

According to the Resolution of the National Assembly Standing Committee, the environmental protection tax rate for gasoline, oil and grease groups is adjusted as follows: gasoline is reduced by 2,000 VND/liter, from 4,000 VND/liter to 2,000 VND/liter; diesel, fuel oil and lubricants reduced by 1,000 VND/liter, from 2,000 VND/liter to 1,000 VND/liter; grease reduced by 1,000 VND/kg, from 2,000 VND/kg to 1,000 VND/kg; kerosene decreased by 700 VND/liter, from 1,000 VND/liter to the floor level of 300 VND/liter. With jet fuel kept at the current level, the discount is 1,500 VND/liter.

The adjusted rate applies from April 1, 2022 to December 31, 2022.

From January 1, 2023, this tax rate will comply with current regulations in Resolution 579/2018/UBTVQH14.

Applying preferential tax rates to 300,000 tons of rice imported from Cambodia

This is the content mentioned in Circular 06/2022/TT-BCT stipulating the import of rice and dried tobacco leaves originating from the Kingdom of Cambodia under tariff quotas in 2021 and 2022.

Accordingly, the total quota in 2022 for rice products is 300,000 tons, if it is paddy, the conversion rate is 2kg of paddy = 1kg of rice; The quantity of 2021 is also 300,000 tons. For dried tobacco leaves is 3,000 tons per year.

Conditions to enjoy special preferential import tax rates

– Imported goods must have a Certificate of Origin form S (C/O form S) issued by the Ministry of Commerce of the Kingdom of Cambodia or an authorized agency according to the regulations of the Cambodian side and carry out import customs procedures. border gates at pairs of border gates specified in Appendix II issued together with Circular 06/2022/TT-BCT.

– Particularly for dried tobacco products, importing traders must obtain a license to import raw tobacco under tariff quotas issued by the Ministry of Industry and Trade according to the provisions of Decree 69/2018/ND-CP and Circular No. December 2018/TT-BCT; the import quantity is deducted from the import tariff quota according to the permit issued by the Ministry of Industry and Trade.

Circular 06/2022/TT-BCT takes effect from April 15, 2022 to the end of December 31, 2022.

Amendment of regulations on independent audit of credit institutions

Circular 24/2021/TT-NHNN has amended a number of regulations on independent audit for credit institutions in Circular 39/2011/TT-NHNN, specifically:

– Amending conditions for independent auditing organizations to audit microfinance institutions and people’s credit funds as follows:

+ Practicing auditors and representatives of independent auditing organizations participating in auditing microfinance institutions and people’s credit funds must fully satisfy the criteria specified in Article 13 of Circular 39/2011/TT – SBV ;

+ Auditing organizations, practicing auditors performing audits of microfinance institutions, people’s credit funds on the list of auditing organizations and the list of practicing auditors approved to conduct audits for entities with public interest as announced by the Ministry of Finance for the period of audit implementation. + Failing to independently audit such microfinance institution or people’s credit fund for 5 consecutive years preceding the year of audit. (Additional content)

+ Not falling into the cases that are not audited as prescribed in Article 30 of the Law on Independent Auditing;

+ Meet other regulations on independent audit as prescribed in guiding documents of the Law on Independent Audit.

– Add the following provisions on independent audit contents:

Auditing the operation of the internal control system of credit institutions and foreign bank branches specified at Points b and c, Clause 2, Article 8 of Circular 39/2011/TT-NHNN in order to ensure the following requirements: the following request:

+ Efficient and safe in operation; protect, manage, and safely and effectively use assets and resources;

+ An honest, reasonable, complete and timely financial and management information system.

Circular 24/2021/TT-NHNN takes effect from April 15, 2022.

Amendment of articles of the system of accounting accounts of credit institutions

Circular 27/2021/TT-NHNN amending and supplementing a number of articles of the system of accounting accounts of credit institutions promulgated together with Decision 479/2004/QD-NHNN (amended and supplemented) by Circular 10/2014/TT-NHNN , Circular 49/2014/TT-NHNN , Circular 22/2017/TT-NHNN ), specifically as follows:

Section II- System of accounting accounts of credit institutions (amended and supplemented) is amended and supplemented as follows:

– Supplementing level III accounts “1391- Specific provision” and “1392- General provision” under account 139- Provision for risks;

– Change the name of the level II account “387- Assets to replace the performance of obligations of the guarantor which has transferred ownership to the credit institution pending” to “387- Collateral to replace for the the performance of obligations of the guarantor has transferred the ownership right to the credit institution pending”;

– Add to account level III “3948- Interest receivable from other credit extension activities” under account 394- Interest receivable from credit activities;

– Change the account name of Level III “4032- Discounted loans, rediscount of valuable papers” to “4032- Discounted loans of valuable papers”;

– Change the account name of level III “4033- Mortgage of valuable papers” to “4033- Loan secured by pledge of valuable papers”;

– Change the account name of level III “4035- Special support loan” to “4035- Special loan”;

– Supplementing level II account “405- Transactions of selling and buying back Government bonds with the State Treasury” under account 40- Debts of the Government and the State Bank;

– Supplementing level II account “495- Interest payable for other credit granting activities” under account 49- Interest and fee payable;

– Add to level III account “4951- Interest payable for other credit extension in Vietnam Dong” and “4952- Interest payable for other credit extension in foreign currency” under account 495- Interest payable payment for other credit granting activities;

– Add to account level II “953- Value of financial leasing assets over time of use” under account 95- Assets used for financial leasing;

– Change the name of Level II account “994- Assets and valuable papers of customers mortgaged or pledged” to “994- Assets and valuable papers of customers mortgaged, pledged and discounted , rediscount”;

– Change the name of the level II account “995- Assignment and foreclosure pending” to “995-Security received to replace the performance of obligations of the pending guarantor.

Circular 27/2021/TT-NHNN takes effect from April 1, 2022.
