On March 29, the People’s Court of Da Nang opened a first-instance trial and sentenced him to 4 years and 6 months in prison for the crime rape people under 16 years old for Nguyen Phan Gia Bao (17 years old, living in Tho Quang ward, Son Tra district, Da Nang).

According to Law and Readers, In December 2020, sister V (SN 2008, now 12 years and 8 months old, living in Man Thai ward, Son Tra district) met her boyfriend LHN (SN 2008, now 12 years and 10 months old) and had sex many times. at the public toilet of apartment S2 (Tho Quang ward).

After breaking up with N, about 2 months later, on February 13, 2021, V made a Facebook friend with Bao. The two invited each other to drink water and fell in love.

On Valentine’s Day, February 14, 2021, Bao took a “child lover” for a day out. Late on the same day, the two visited Bao’s classmate’s house in apartment S2 (Tho Quang ward) to ask for a bed. Here, all 3 sleep in the living room, Tr. covered with a blanket separately, and Bao and V. shared a blanket, Bao asked V to have sex, then he agreed.

On the morning of February 15, 2021, Bao took V to play on the internet until the evening of the same day, he returned to Bao’s friend in Tho Quang ward to drink alcohol. After drinking, the three went to bed. In the morning of February 16, 2021, Bao continued to invite sex and V agrees.

In the morning of February 20, 2021, Bao took his girlfriend to drink coffee all day, until late at night, the two rented a motel in Ban Mai (Tho Quang ward) to spend the night and have sex.

On the morning of February 21, 2021, both of them checked out of the room and left. V’s mother was suspicious, so she asked, then she heard her daughter tell her story about having intercourse with her new lover, so she went to the police to report the incident.

On July 9, 2021, Bao’s family compensated V’s family and V’s family filed an application for annulment.

DNA test to track down baby’s father

According to Business and Marketing said, before Bao was arrested, LHN (V’s ex-boyfriend) also had sex with V many times at the apartment’s public toilet. However, at this time, both are just over 12 years old, not yet old enough to be criminally responsible.

Notably, after V’s family denounced the act of having sex with a person under the age of 16, V became pregnant and has now given birth to a baby.

At the trial, the jury said that through DNA testing, the baby was not Bao’s child. The trial panel immediately requested the investigating agency to additionally investigate and clarify the father of the child to consider other signs of crime (if any).
