Already have a new citizen ID, can I still use the old one?

1. Making a new citizen’s identity with the old people’s identity card being revoked

According to the provisions of Article 11 of Circular 59/2021/TT-BCA, police officers will collect the credit card, CCCD card in use when citizens carry out the procedures to change from ID card to CCCD card or change CCCD card.

However, after making a new ID card, many people still keep their old ID card because they declared it lost, didn’t hand it over or the procedure officer forgot to collect it…

This causes some people who have made a new CCCD to have two types of ID cards at the same time, namely the newly made CCCD and the old ID card.

2. Can I use my ID card when I already have a Citizen ID?

ID card and CCCD are both valid to prove a person’s identity when participating in civil transactions or performing administrative procedures.

For cases where it is only used for comparison and identification and does not need to record the ID number, the use of the old ID card has almost no effect.

However, if you use the expired old ID card to enter into contracts, transactions or perform administrative procedures, users will likely face legal risks in the future. For example, the contract signed to use the expired ID card will be invalidated.

Therefore, people should only use the new CCCD in all transactions and procedures to ensure information consistency and avoid future risks and disputes.

Even if people hold both CCCD and ID cards, they absolutely should not use them at the same time.

The use of documents with personal information as the old ID card number in transactions and administrative procedures together with the new CCCD is completely accepted. Because, on the CCCD card with the new chip, all information about the old ID card is now integrated.

3. Is there a penalty for using an expired ID card?

According to the above regulations, the collection of old ID card after making a new CCCD is mandatory.

Therefore, if using an expired ID card after applying for a CCCD, a citizen may commit the mistake of “failing to comply with the provisions of law on issuance, exchange and re-issue of citizen identification cards”.

According to the provisions of Clause 1, Article 10 of Decree 144/2021/ND-CP, users will be warned or fined from 300,000 to 500,000 VND.

4. When is it mandatory to switch to CCCD with chip?

According to Article 38 of the Law on Citizen’s Identity, ID cards issued before the effective date of this Law (January 1, 2016) are still valid until the expiration of the prescribed period. In case citizens request, they can change to CCCD card.

According to Clause 2, Article 4 of Circular 06/2021/TT-BCA, CCCD cards issued before January 23, 2021 are still valid until the end of the prescribed period. In case citizens request, they can change to CCCD card with chip.

Thus, the cases of citizens who have been issued ID cards, CCCDs with barcodes but still intact, still have the expiry date, not in the case of having to change or re-issue, if people have not yet had a need to change to CCCD with chip attached. It can still be used until it expires.

The end of 2043 is the time when all ID cards, CCCD barcodes have expired. This is the time when people all over the country synchronously use CCCD with chip.

For those who have made barcode CCCD in January 2021 and are subject to CCCD card with indefinite validity, they can use the card for the rest of their life without changing to CCCD with chip.
