Former director of Ocean Bank Hai Phong denied embezzlement of 414 billion dong

On the afternoon of March 31, the Supreme People’s Court opened an appeal session for embezzlement of 414 billion VND in deposits of many customers, according to the appeal of Tran Thi Kim Chi, director of Ocean Bank Hai Phong branch.

The court allowed the three defendants Le Vuong Hoang (former controller) and Nguyen Thi Minh Hue (former head of the treasury accounting department) and Chu Van Nha (former treasurer) to be brought to the courtroom.

Defendant Chi did not admit embezzlement; did not direct Hoang, Hue and Nha to forge documents and signatures to short-term settlement of customers’ savings accounts in order to appropriate a deposit of nearly VND414 billion.

Recalling Chi’s testimony, defendants Hoang, Hue, and Nha said that the indictment was against the right person. The forging of records, signatures and savings books of customers is carried out under the direction of the director of Chi.

The representative of the defender of rights and responsibilities for the Head Office (Ocean Bank) said that returning the money to the victim was the responsibility of the four defendants Chi, Hoang, Nha and Hue. Defendant Chi was appointed as the director of Ocean Bank Hai Phong branch but only took on the position of manager and operator, and signed documents and closed credit accounts by the head of the Head Office. The head office is only responsible when the customer’s deposit has been displayed on the electronic management system of the bank.

Lawyers for the clients and representatives of the Supreme People’s Procuracy shared that Ocean Bank was responsible for paying principal and interest to depositors. Because the four defendants are all under the management of the bank. The sender has transferred the money, in return the bank transfers the red stamped passbook.

The defendants claimed that a customer’s deposit had been transferred by Chi to Vietinbank to receive the difference of interest. That profit, the defendants divided among themselves and played lottery. Defendant Chi said that after the disclosure, he withdrew all deposits with Vietinbank to pay customers.

The trial panel then stopped the trial and will reopen on April 5.

According to the first-instance judgment issued on the morning of September 4, 2020, the People’s Court of Hai Phong imposed the death penalty on defendant Chi; Le Vuong Hoang (former controller) and Nguyen Thi Minh Hue (former head of Treasury Accounting Department) were sentenced to life in prison; Chu Van Nha (former treasurer) was sentenced to 20 years in prison.

The court ordered Ocean Bank to be responsible for paying all principal and interest for 27 customers who opened savings cards that were appropriated by Chi and his accomplices.

According to the indictment, from 2012 to August 2017, the defendants abused their positions and powers and took advantage of the bank’s loopholes in the management and issuance of savings cards to customers. They used deceitful tricks, received savings deposits from customers but did not record them into the bank’s management system.

The defendants then closed the settlement, falsified customer’s savings card mortgage loan documents, issued 109 savings cards outside the system to 27 customers, appropriated nearly 414 billion VND from Oceanbank Hai Phong branch. copper.
