Kill the creditor, dispose of the body in Hai Duong
On March 31, the High People’s Court in Hanoi has just decided to bring the case of murder and destruction of the creditor’s body that happened in Hai Duong to an appellate trial. This trial will take place on the morning of April 8 at the People’s Court of Hai Duong province.
Judge Nguyen Xuan Dien presides over, defending the defendant has 3 lawyers. The appellate court attendants were Cao Talent (40 years old) and this defendant’s wife was Vu Thi Mung (38 years old, living in Hai Duong city).
Defendant Cao Talent appeared in court after killing the creditor and disposing of the body.
In the appeal, Nang asked to reduce the punishment for the crime of Murder, Infringing upon the body and remains, and at the same time claiming that he did not commit the crime of Robbery.
As for the defendant, Mung would like to reduce the punishment for the crime of concealing the crime, and at the same time, believe that he did not commit the crime of trespassing on the grave because he did not participate in and assist in the burial and burning of the victim’s body.
According to the indictment, Nang and her husband rented a house at 126 Nguyen Thuong Man (Binh Han ward, Hai Duong city) to open a new pharmacy.
When doing business, Nang and his wife borrowed more than 7 billion VND from Mr. Duong Cong Cuong (47 years old, living in Gia Loc district). Later, the couple paid more than 4 billion dong. The remaining amount was nearly 3 billion VND, they asked for alms, but Mr. Cuong did not agree and promised to meet on November 28, 2020 to pay.
The victim’s relatives were present at the first instance court.
That morning, Nang saw no one in the pharmacy, so he invited Mr. Cuong to come here, kill him with a wooden stick, then drive the victim’s car to Hanoi, leaving the car at the roadside in the Kim Van – Kim Lu urban area.
After taking a taxi back to Hai Duong, Nang went to the banks of the Kim Son River to dig a hole about 2 meters wide with a hoe. In the evening, Nang told his wife that he had committed the murder. Glad to have advised her husband to turn himself in.
Fearing that Nang would be taken to jail and threatened with suicide, the woman agreed to help when her husband asked for help. Right in the night, the couple took a car to the pharmacy, carried the victim’s body to the riverbank to bury.
On the afternoon of November 29, 2020, Nang took his wife to Hanoi to erase the traces on the car. After that, Nang often went to the place of burial to examine the situation and discovered that some new trees had been planted.
Fearing that the incident would be revealed, on the evening of February 8, 2021, Nang and his wife bought 6.5 liters of gasoline and some tools to the riverbank to dig and burn the body. On July 1, Nang surrendered.
Police examine the scene at the pharmacy where the main scene in the creditor’s murder, dispose of the body.
At the first-instance trial on November 18, 2021, the Hai Duong Provincial People’s Court sentenced defendant Nang to death for murder, robbery, and trespassing on bodies, graves and remains.
Defendant Mung was sentenced to 6 years and 6 months in prison for concealing crimes and trespassing on bodies, graves and remains.
After this trial, the victim’s family also filed an appeal against a part of the first-instance criminal judgment to the High People’s Court in Hanoi.
Accordingly, the victim’s family said that the procedure-conducting agency had not fully verified, investigated and evaluated the details of the case. They asked to consider the handling of defendant Mung as an accomplice, assist Nang in committing the crimes of Murder, Robbery and consider the aggravating circumstances for the 2 defendants.
