In addition to defendant Nguyen Chien Thang, defendant Le Mong Diep (former director of the Department of Natural Resources and Environment) and four other defendants were also prosecuted for the same crime.

In response to the court’s interrogation, Mr. Thang admitted to having emotional thoughts when allocating 513ha of land to expand the project of villas and eco-tourism in Dat Lanh economic zone (now Cuu Long Son Tu spiritual ecology). when the enterprise has not adjusted the certificate, wrong planning, contrary to the land use plan.

The former Chairman of the province said that at that time he thought that this area was bare hills and rocky mountains. The business asking to keep to take care is a very precious job, so initially there was an idea of ​​exempting land use fees. However, Khanh Hoa Tax Department has written that there is no legal basis to exempt land use levy for this area, so Mr. Thang assigned the Department of Natural Resources and Environment and the Department of Agriculture and Rural Development to agree with the Tax Department to submit advice to the Tax Department. Provincial People’s Committee.

Then, as the head of the Provincial People’s Committee, he held meetings with relevant departments. There are many different opinions on the above issue, but in general, the law only reduces the tax on zoning for regeneration and protecting the forest environment, but not exemption.

“Therefore, I have concluded that I have not yet collected taxes, wait for the instructions of my superiors and then continue to calculate. However, after I retired, the tax exemption agencies later found myself irrelevant,” Thang said.

As for the mistake when signing the decisions to increase the total area for the Cuu Long Son Tu project to 513 hectares, including non-agricultural production land and rural land, the former provincial chairman said, he followed the advice. of the Department of Planning and Investment and the Department of Natural Resources and Environment. At the same time, he also admitted that he was wrong about signing the decision to increase the project area before the decision to adjust the project investment certificate, but this is only wrong about the signing order, not criminal.

Mr. Thang explained to the court, when he was still in office, every day the office signed about 50-100 documents. He couldn’t check it all.

In addition, the decision on land allocation where there is a flashed signature, the defendant will sign it, but it will take 45 days to finish reading all the documents.

“I don’t blame the departments, but I trust my subordinates to advise and trust the report of the Department of Natural Resources and Environment, so I signed it. Anything else I’m wrong, I’m responsible”, Mr. Thang said, and admitted. when he signed the above decisions, he did not know that he was wrong, only later working with the authorities and investigating agencies did he realize that he was wrong and must be responsible for his signature in those wrong decisions.

Meanwhile, in response to the interrogation of the jury, defendant Le Mong Diep expressed that he was very sad and disappointed about Mr. Thang’s testimony when he said that the violations “the main responsibility belongs to the advisory body, which is the Department of Natural Resources and Environment”.

The defendant said that the project’s goal is to protect forests and serve ecology. The Department of Natural Resources and Environment only implements the project process, the previous consulting unit was the Department of Agriculture and Rural Development. Mr. Diep himself, while still in office, signed reports to advise the Provincial People’s Committee related to the above project, following the direction of the Provincial People’s Committee.

In addition, the Department of Natural Resources and Environment also bases on the document of the Department of Agriculture and Rural Development on the appraisal of the design of the afforestation and forest protection facilities.

According to Mr. Diep, this project was also approved by the Standing Board of the Provincial Party Committee and the Party Personnel Committee of Khanh Hoa Provincial People’s Committee at previous meetings related to the project.

According to the indictment, 7 former provincial leaders are accused of signing many illegal documents in allowing the change of land use purpose, granting land use right certificates, leasing land, approving land prices related to land use rights. The Cuu Long Son Tu spiritual ecology project and the Vinh Trung mountain river villa project are located in the Chin Khuc mountain area in Khanh Hoa.

Mr. Nguyen Chien Thang, when he was incumbent Chairman of the Provincial People’s Committee for the 2011-2015 term, signed documents directing investment and project implementation with signs of violation of the Land Law.

As for Mr. Le Mong Diep, when he was still in office, he signed reports to advise the Provincial People’s Committee to issue illegal decisions on land allocation.

Tomorrow, the jury will continue to question the defendants on related issues.
