According to regulations, in wards and townships, the minimum area does not include the restricted land area of ​​land parcels formed from the separation of parcels and the land parcels after separation is not less than 40m2; In communes of towns and cities, the minimum area is not less than 50m2, in communes of districts, the minimum area is not less than 60m2.

In case when separating the parcel, there are additional roads and technical infrastructure, when separating the land parcel, the land user shall have a voluntary application to return the land to build a road to separate the parcel, enclosed with a drawing of the total area of ​​the land. For non-agricultural land that is not residential land, according to the decision of Thai Nguyen Provincial People’s Committee, the minimum area of ​​the land parcel after separation is not less than 100m2; the separated land plot must have a use purpose consistent with the land use planning, detailed construction planning; In case the land plot originates from land allocated or leased by the State for the implementation of an investment project, it is only allowed to separate the parcel with the consent of the investment-approving agency.

The new decision of Thai Nguyen province also stipulates specific conditions for splitting agricultural land.

Accordingly, for land for growing annual crops, land for growing perennial crops and land for aquaculture: the minimum area of ​​land parcels after separation is equal to or greater than 150m2/plot.

For production forest land: the minimum area of ​​land parcels after separation is equal to or greater than 1,000m2/plot.

After the agricultural land parcel is split, the water supply and drainage must be ensured, and registration must be made to establish the limited use right to the adjacent land plot in accordance with the provisions of the Land Law, the Civil Code.. .
