To avoid this situation, Mr. Chuc said that the revised law must perfect institutions, ensure that organizations and individuals that make and create products must register for intellectual property rights. Along with that, State management agencies must also create favorable conditions for organizations and individuals to register intellectual property rights.

The story of intellectual property rights of Vietnamese products falling into foreign hands is particularly noticeable in 2021. At that time, ST24 and ST25 rice were researched and bred by engineer Ho Quang Cua and a group of scientists. , in which ST25 won the world’s best rice award at the contest in the Philippines in 2019 and second prize in 2020 in the contest in the US. In Australia, ST25 rice is also being registered for trademark protection by an enterprise. In case a US enterprise is granted a trademark certificate, a Vietnamese enterprise that wants to export these two types of rice to the US will have to go through the brand owner in this country.

Assoc. Prof. Quach Sy Hung, Deputy Chairman of the Democratic-Legal Advisory Council, also said that developing the country requires economic power and intellectual power, in which intellectual power is very important. This law amendment needs to focus on protecting that intellectual power.

Participants in the Copyright Protection Association must have the capacity and in-depth legal knowledge to perform their duties well; at the same time, there must be a court specializing in handling intellectual property-related cases, similar to a court on marriage and family.

Assoc. Prof Hung also suggested developing a regulation to severely sanction acts of infringing upon intellectual property rights, including criminal ones, especially in the context of widespread counterfeiting and counterfeiting, harming consumers and the economy. manufacturing.

Vice Chairman of the Central Committee of the Vietnam Fatherland Front Nguyen Huu Dung assessed that, after 16 years of implementation, the Intellectual Property Law has played an important role in regulating legal relations with respect to intellectual property. wisdom. “The Intellectual Property Law was revised and supplemented twice in 2009 and 2019, but has not yet created a strong motivation for investment in research and innovation,” Dung said.

The draft Law on amendments and supplements to a number of articles of the Intellectual Property Law was drafted by the Ministry of Science and Technology and submitted to the National Assembly for comments at the second session (October 2021). The bill will be considered and approved by the National Assembly at its third session, which opens in May.
