Being prevented from buying beer when he was drunk, Nghiep angrily slapped Mr. Tuan’s face, causing the victim to bleed from his eyes, leading to blindness.

On April 13, the People’s Court of Hanoi brought the accused Ho Huy Nghiep (SN 1977, in Dong Anh, Hanoi) for an appeal trial for the crime of intentionally causing injury.

According to the case file, around 9:15 p.m. on July 15, 2018, Mr. Hoang Anh Tuan (SN 1981, in Dong Anh) walked to the beer shop of Nguyen Thi Diem and his wife (in Dong Anh town) to sit and drink.

At this time, defendant Nghiep also rode a motorbike to buy beer to drink. Seeing that Nghiep showed signs of being drunk and because she had run out of beer, Ms. Diem said: “My house is out of beer, I’ll come and get beer tomorrow”. But Nghiep refused, begged Ms. Diem to sell him beer, causing both sides to raise their voices.

Witnessing the incident, Mr. Tuan advised: “Stop drinking enough, then go home, don’t speak loudly, affecting other people watching football”. Hearing that, Nghiep went to Tuan’s place and slapped him in the face, causing a scuffle between the two sides. Due to not being able to dissuade the two guests, the owner asked the defendant Nghiep and Mr. Tuan to go out and close the door.

At this time, Mr. Tuan and Nghiep rushed to struggle and fight. Karma waved his hand and punched Tuan’s left eye, causing the victim to bleed from his eye and could not see anything.

Before that, Mr. Tuan’s right eye was blind because of a traffic accident in 2004 and had to be fitted with a prosthetic eye. Nghiep told Tuan to get on a motorbike so I could take him to the hospital for an emergency, but Tuan didn’t agree, so the defendant drove away.

Mr. Tuan was then picked up by his relatives and taken to the hospital for emergency treatment. According to the conclusion of the injury assessment, the total rate of damage to Mr. Tuan’s health was 87% including both eyes because the left eye was blind and could not recover while the right eye was fitted with a prosthetic eye.

With the above behavior, Nghiep was sentenced to 6 years in prison by the first instance court for the crime of “Intentionally causing injury”, and had to pay compensation to Mr. Tuan and his caretaker with a total of 7.4 million VND/month. After that, defendant Nghiep appealed for a reduction of the sentence and was accepted by the appellate court, reducing it to 5 years and 6 months in prison.

However, after the appellate court hearing, the accused’s mother Nghiep made a complaint and petitioned for her son. According to the cassation decision of the High People’s Court in Hanoi, the amount of money that the first-instance court ordered the defendant to compensate Mr. Tuan and expenses for the person who regularly took care of Mr. Tuan totaled 7.4 million VND/ month is too high.

Therefore, the cassation level canceled a part of the civil first-instance criminal judgment. By the end of September 2021, the People’s Court of Dong Anh district had brought the case to settlement according to the general procedure and defendant Nghiep had to pay compensation for the costs of raising Mr. taking care of Mr. Tuan with a total amount of more than 1 million VND/month. After the above trial, the defendant’s mother continued to appeal that her son did not commit a crime. Meanwhile, the injured side appealed for an increase in compensation.

At this trial, the Hanoi People’s Court rejected the defendant’s mother’s appeal, accepting part of the victim’s appeal. Accordingly, the jury forced the defendant Nghiep to compensate the victim and the caregiver’s expenses to 1.4 million VND/month, an increase of 400 thousand VND compared to the first-instance judgment.
