Singer Ly Hai was sued for copyright infringement

In the petition, Mr. Nhat said that the poem Mother’s Burden was composed by him in 2014 while taking care of his seriously ill mother at the hospital. On June 13, 2014, he posted the entire poem on Facebook “Tho Van”. On the same day, the poem was shared by Facebook account Cao Ly Nguyen Thi.

By the end of July 2014, he re-posted the poem on his personal Facebook page, all of these contents have been compiled. Nhat affirmed that he is the author and the sole owner of the poem.

In 2019, he discovered that singer Ly Hai’s company used the song Mother’s burden Quach Been’s music, has lyrics illegally taken from his poem of the same name in the movie Flip 4 – House With Guests. He contacted Quach Beem and singer Ly Hai to solve the case, asked both to publicly apologize, and edit all publications containing the song. Mother’s burden is the music of Quach Beem, the lyrics of Truong Minh Nhat’s poem, and stop using the poem.

However, the company Ly Hai and musician Quach Been for the use of the song Mother’s burden was legal, did not agree with the request, so Mr. Nhat sued.

In court, Mr. Nhat said that the defendant had illegally used the poem Mother’s burden to make music and use it for the movie, asking Ly Hai Production Co., Ltd. to name him as the author of the poem. Mother’s Burden on film Flip 4 – House With Guests and all related articles, posts, and other disclosures; At the same time, he asked Ly Hai’s company to compensate for the loss of VND 825 million. For Mr. Doan Dong Duc, Mr. Nhat requested that the exploitation of the poem be suspended Mother’s burden on all vehicles, platforms and compensation for more than 500 million VND.

Giving his point of view, singer Ly Hai’s side did not agree with Mr. Nhat’s request to sue because he thought that the evidence the plaintiff provided to the court did not contain any content showing the film. Flip 4 – House With Guests use his poems.

In the movie, the company only used music as a song Mother’s burden Doan Dong Duc and this author agreed to approve the license transfer contract signed by the two parties on April 3, 2019. This part of the song is only included at the end of the movie, not performed throughout the movie. The film also uses many other background music.

The company’s representative also said that at the time of signing a contract to use the song, the company “didn’t know and had no way of knowing” whether there was a copyright dispute. This song has been used by many famous singers and programs for a long time (2016).

In addition, the song Mother’s burden was granted a copyright registration certificate by the Copyright Office to Mr. Doan Dong Duc. In the event of a dispute, the plaintiff must prove that he has been recognized as the author of the poem Ganh Me and is a co-author of this song in order to have a basis to request the related parties to respect the copyright. fake.

In defense of Mr. Doan Dong Duc, the lawyer also asked the court to dismiss the plaintiff’s entire claim, because the song Mother’s burden has been granted a copyright registration certificate by the Copyright Office to the client. Mr. Nhat sued is obliged to prove his authorship of the poem.

After many working hours, the trial panel is expected to continue the trial on the afternoon of April 25.
