What are the conditions for enjoying social insurance benefits when taking maternity leave?

An antenatal check-up is one of the benefits of the maternity regime. Specifically, according to Articles 30 and 31 of the Law on Social Insurance 2014, female employees will be entitled to the antenatal care regime if three conditions are met at the same time.

1. Belongs to one of the following subjects:

– Employees working under labor contracts with a term of full 1 month or more.

– Subjects of cadres, civil servants and public employees.

– Defense workers, police workers, people working in cipher organizations.

– Professional officers and soldiers; officers, professional non-commissioned officers, officers and professional non-commissioned officers of the People’s Public Security; People who do cipher work receive salaries like soldiers.

– The enterprise manager, the executive manager of the cooperative enjoys salary.

2. Participating in compulsory social insurance.

3. Pregnancy.

If the above conditions are met, the female employee will be entitled to take leave from work to go to antenatal care 5 times during her pregnancy (according to Clause 1, Article 32 of the Law on Social Insurance 2014).

Not enough 5 certificates of maternity leave to get insurance money?

According to the conditions, female employees only need to participate in compulsory social insurance during pregnancy to be entitled to maternity leave. On the other hand, Decision 166/QD-BHXH stipulates that the application for antenatal care benefits submitted to the social insurance agency only needs to have the following documents:

– The original Certificate of leave to enjoy social insurance.

– A list of requests for maternity benefits, made according to form 01B-HSB, made by the employer.

In which, Decision 166/QD-BHXH also does not require a sufficient number of 05 leave papers to enjoy social insurance.

So, If there are not enough 5 certificates of maternity leave, female employees will still be paid social insurance premiums. In other words, even if a female employee does not go to antenatal care for 5 times, she is still paid social insurance in proportion to the actual number of times she goes for antenatal care.

How much social insurance do you get for maternity leave?

Pursuant to Article 32 of the 2014 Law on Social Insurance, pregnant female employees will be entitled to the antenatal check-up regime for the following period:

– Normal case: 5 times of maternity leave (1 day/visit).

– In case of being far away from medical examination and treatment establishments or the pregnant woman has a medical condition or an abnormal pregnancy: 5 times of antenatal care leave (2 days/visit).

Accordingly, the time off is calculated by working days, excluding public holidays, Tet, and weekly rest.

Article 39 of the Law on Social Insurance 2014 stipulates that the amount of money a female employee receives during her maternity leave will be calculated according to the following formula:

Amount of maternity leave = 100% x Average salary of the months covered by social insurance: 24 x Number of days off

Example: Ms. A pays social insurance monthly with a salary of 10 million VND/month. During the maternity period, Ms. A took 5 days off for antenatal care, 1 day each time.

Total amount of antenatal care regime for Ms. A = 100% x 10 million VND: 24 x 5 days = 2,083,333 VND.
