Penalties for driving on the sidewalk

In big cities like Hanoi or Ho Chi Minh City. In Ho Chi Minh City, traffic jams often occur, so motorcyclists often go on sidewalks to go faster. This not only violates the road traffic law but also affects the safety of pedestrians on the sidewalk.

According to Decree 100/2019/ND-CP on specific fines for violations of walking on sidewalks, specifically as follows:

For motorbikes traveling on sidewalks

According to the provisions of Point G, Clause 3, Article 6 of Decree No. 100/2019/ND-CP, motorbike drivers do not go on the right in their own direction, go in the wrong part of the road & lane, and ride on the sidewalk. (except for the case of driving a car through the sidewalk to enter the house) will be fined from 400 to 600 thousand VND, the previous fine was only 300-400 thousand VND.

In the absence of a sign prohibiting going in the opposite direction on the sidewalk, the driver of the vehicle traveling in the opposite direction on the sidewalk will be fined for the error of driving on the sidewalk, but not in the opposite direction.

For cars going on the sidewalk

According to Point D, Clause 5, Article 5 of Decree 100/2019/ND-CP, car drivers do not go to the right in their direction, do not go in the wrong part of the road & lanes, ride on the sidewalk (except for drivers who drive across the sidewalk to enter the house) are fined from 3 to 5 million VND, the previous fine was only from 800,000 VND to 1.2 million VND.

The additional penalty for driving a car on the sidewalk is also deprivation of the right to use the driving license for 1-3 months.

Penalty for parking on the sidewalk

Drivers often want to park their cars neatly and avoid traffic jams, so they put 2 wheels on the sidewalk. Although this is quite a conscious act, it is still violated and administratively handled in terms of the law.

According to Point E, Clause 3, Article 5 of Decree 100/2019/ND-CP, acts of stopping and parking at the wrong place and parking the wheelbarrow on the sidewalk will be fined from VND 800,000 to VND 1 million. In addition, the fine will be up to 2 million VND when the vehicle stops/parks on the left side of a one-way street or parallel to another stopped/parked vehicle as prescribed in Point D Clause 4 Article 5 of this Decree.

In case, the area has plate number 408a, new cars are allowed to park their cars on the sidewalk.

Thus, parking a car on the sidewalk is a violation of traffic laws and will be administratively handled with a relatively high fine. Therefore, car drivers need to pay attention to avoid losing money and time.
