Previously, in response to the trial panel, Minh maintained his appeal against the claim that he did not intentionally kill Vuong. During the initial investigation, the defendant confessed to being “bored”.

The defendant testified that on May 3, 2020, he went from his farm house to Vuong’s farm house. As soon as he got to the door, he was run by his nephew’s dog in the field, so Minh picked up a hammer and threw it at the dogs. At the same time, Vuong in the house ran out, unfortunately, was hit in the head with a hammer, so he lost consciousness. Minh put Vuong on a pickup truck to take him to the emergency room, but on the way, the victim died. He then brought the victim’s body back, left the shack and then went to a hotel in Gia Nghia city to rest. At 2am the next day, Minh returned to the field to carry Vuong’s body back to Lam Dong, but when he went to Dak Som commune, Dak Glong district, the car had a technical fault.

“The defendant intended to use the phone’s flashlight to look at it, but couldn’t find it, so he took the box to light it. Unfortunately, the fire caught on the fuel tank and caused the car to burn,” Minh said, and said that this was an unintended “incident”. , rather than intentionally creating a fake scene.

The defendant also said that he did not commit a crime Destruction of property by a company’s acquired pickup truck. At the time of the case, the defendant still owed money, but the family paid it and was also asked by the company’s representative to be exempt from criminal liability.

Defending Minh, the lawyers said that during the investigation and trial at the first instance level, serious procedural violations were committed. There was no lawyer involved in the process of taking testimony, not experimenting on the scene, summoning witnesses… requesting the jury to cancel the first-instance judgment, investigate and re-trial.

Giving his opinion on the case, the representative of the Procuracy said that Minh’s testimony was “without basis to accept”. The dog is three centimeters tall, while the victim is nearly 1.7 meters tall, so it’s not likely that Minh accidentally threw the dog’s hammer and hit the victim. According to the VKS, the scene minutes showing blood stains were not the same as Minh’s testimony, so he asked the appellate court to reject the appeal.

According to the jury, the first instance level had some procedural violations but did not change the nature of the case. At the court, defendant Minh complained, saying that he only “unintentionally” caused the death of his wife Tran Nho Vuong, 25 years old, but did not intentionally kill, but there was no basis to accept it.

On the afternoon of May 3, Minh visited a field hut in Dak G’long district of Tran Nho Vuong’s grandson, cooked rice, and then spread a mattress to sleep. Late at night, the defendant intended to use a hammer to continue to pry open the coffin lid to retrieve the body, but then had the intention to kill Vuong, hit him twice on the forehead with a hammer, causing the victim’s death. Minh put the body on his pickup truck and ran to Highway 28, Dak Som commune, Dak G’Long district – about 70 km from the crime scene, crashed the car into a roadside marker to create the scene of the accident. Next, he put Mr. Vuong’s body in the driver’s seat, put his watch on the victim, left the key… and burned the car with 3 cans of oil and one can of gasoline.
