Series of violations and errors in Mai Dich Nam Thang Long viaduct project 5,343 billion VND

Increase the estimated value of bidding packages by more than 27 billion VND

Chief Inspector of the Ministry of Construction Nguyen Ngoc Tuan has just signed and promulgated the conclusion of the inspection of Thang Long Project Management Board – Ministry of Transport in the management of construction investment activities, including: project to build viaduct at Mai Dich – Nam Thang Long section of Ring Road III (Hanoi).

The project was approved in 2013 by the Ministry of Transport as the investor, Thang Long Project Manager is the representative of the investor. The project has a total length of 5.36km in two districts of Cau Giay and Bac Tu Liem, of which the viaduct length is 4.831km. The project has a total investment of more than 5,343 billion VND, using Japanese ODA loans and domestic counterpart funds.

The inspection conclusion pointed out many violations and errors from the legal documents at the stage of investment project formulation; elaboration, verification, appraisal and approval of technical design, construction bidding package estimate; contractor selection, contract signing to compliance with regulations when using foreign contractors.

Specifically, the dossier for the formulation of an investment project for construction of works lacks fire prevention and fighting content in violation of the Law on Construction No. 16/2003.

In the work of making, verifying, appraising and approving the technical design, design drawings of the concrete casting vehicle system for the bridge deck, concrete balustrade, the site of the cement concrete batching plant, the SuperT beam casting yard Incomplete parameters, size therefore calculation of mass has no basis.

The work of making, verifying, appraising and approving construction package estimates still has some errors, increasing the estimated value of bidding packages by more than 27 billion VND.

Regarding contractor selection, Thang Long PMU did not publicly publish in the Bidding newspaper the results of contractor selection for consultancy bidding packages for construction investment project verification.

The inspection conclusion also indicated that the construction and installation bidding package contract is a coefficient-based price adjustment contract. Information on prices or construction price indexes of competent state agencies is absent or exists but is not suitable with the content, nature of work and specific conditions of the contract.

Slow progress

According to the Inspector of the Ministry of Construction, the project to build the viaduct at the Mai Dich – Nam Thang Long section has used foreign experts, but during the implementation process, the Thang Long PMU did not implement a series of contents. Failing to notify the managing agency and related agencies within 30 days before the expert ends his working time in Vietnam.

Failure to report to the governing body every 6 months and annually on the management and use of experts. There is no written certification of foreign experts and confirmation documents are sent to relevant agencies to perform state management in accordance with current law and take responsibility for this certification.

In addition, in this project, many foreign contractors violate the reporting requirements. Sumitomo Mitsui Construction Company Limited; Tokyu Construction Co.,Ltd; Taisei Corporation Company; Oriental Consultants Global Co.,Ltd; Katahira & Engineers International Company does not periodically report on December 20 every year and after completing the contract, send it to the Ministry of Construction on the performance of the signed contract.

Oriental Consultants Global Co.,Ltd; Katahira & Engineers International Company; Company Nippon Koei Co.,Ltd; Nippon Engineers Consultants Co.,Ltd (Ne); Nippon Koei Vietnam International Co., Ltd (NKV) does not make a regular report every 6 months and when completing the contract, send it to the Ministry of Construction.

“Regarding the purchase of insurance for workers on the construction site, according to Decree 119/2015, for insurance for construction workers on the construction site, the minimum insurance amount is 100 million VND/person. Then the construction contractor is JSC 412; Joint Stock Company 423; Licogi 12 Joint Stock Company; Hai Anh Co., Ltd only buys insurance for workers on the construction site with the insurance amount of 10-20 million VND/person/case, which is not in accordance with the prescribed minimum limit” – said the inspection conclusion.

Also according to the Inspectorate of the Ministry of Construction, the investor started the work but did not notify the time of construction commencement together with the construction design dossier to the local construction management agency for monitoring and record keeping. is a violation of the Construction Law.

The project approved in Decision No. 2660 dated September 3, 2013 has an implementation period of 56 months. The Ministry of Transport has extended the project completion schedule to December 31, 2021. At the time of inspection in March 2022, the project was still incomplete. Thus, the project was delayed by nearly 3 months.

With the above violations, the Inspector of the Ministry of Construction requested the Thang Long Project Management Board and related units to carry out the procedures to approve the adjustment and reduction of the construction cost estimate of more than 27 billion VND.

In addition, the Ministry of Transport is requested to review the responsibility according to its competence to organizations and individuals involved in violations and errors.

For Thang Long PMU, the Inspector of the Ministry of Construction also suggested reviewing the responsibility according to its competence to organizations and individuals involved in violations and errors.
