Former General Director of Dong A Bank is about to appear in court for the 3rd case

It is expected that on May 19, the People’s Court of Hanoi will hold a first-instance trial of Mr. Tran Phuong Binh, former General Director of Dong A Commercial Bank (DAB) and 9 other accused in the case of loss of 184 billion VND.

The trial is expected to take place in 3 days, chaired by Judge Tran Thi Tam, 7 lawyers registered to participate in protecting the rights of the defendants and civil plaintiffs.

This is the third case Mr. Tran Phuong Binh has been brought to trial.

Before that, in 2018, Mr. Binh received a life sentence in the case of Phan Van Anh Vu (ie Vu “aluminum”) and accomplices to appropriate and lose money of DAB Bank.

In 2020, Mr. Binh continued to receive a second life sentence in the bank’s loss of more than VND 8,000 billion.

According to the allegation, from 2007 to 2014, An Phat Company (addressed in Me Linh district) by the accused Phan Thuy Mai, as its director, borrowed money from DAB Bank, Hanoi branch many times.

The Procuratorate said that in the process of granting credit to An Phat Company, some leaders of the Head Office and DAB Hanoi Branch officials committed many violations of lending regulations of credit institutions. Formalize credit dossiers, grant credit when conditions are not met.

The above violations caused damage to many shareholders of An Phat Company, therefore, Ms. Truong Kim Bich (member of the Board of Directors of the Company) sent an application to the investigating agency to denounce the behavior of Phan Thuy Mai and the DAB team. .

The indictment of the Hanoi People’s Procuracy determined that the defendant Phan Thuy Mai took advantage of the close relationship to lobby DAB General Director Tran Phuong Binh and Deputy General Director Nguyen Thi Kim Xuyen to direct DAB Hanoi branch. making documents quickly, bypassing the appraisal process, not following the procedures for registration of secured transactions, so that An Phat Company can disburse the credit.

Mai herself uses assets that are not legal enough to mortgage and secure loans; using fake Board of Directors meeting minutes to transact bank loans.

Mr. Tran Phuong Binh is accused of directing DAB’s Hanoi branch to help Mai borrow money because he did not want An Phat Company to “reverse old debts”, to prevent DAB from increasing bad debts. And Nguyen Thi Kim Xuyen helps Mai because of her relationship and personally contributed 5% of the shares to An Phat Company to invest in the Spring 79 Hill Project.

In addition, the prosecution said that in 2008, defendant Mai signed a false contract to show that An Phat Company borrowed 185,000 gold only from DAB Bank, but in reality, without this loan, the gold has not been disbursed. The signing of a false contract to help Tran Phuong Binh hide DAB’s lost gold.

This is also the reason for later Tran Phuong Binh “respected” Mai, helping this businesswoman borrow money. The gold loan contract is being prosecuted by the Ministry of Public Security’s investigative agency for handling in another case.

DAB Hanoi Branch staff know that Mai is a ‘VIP’ customer and has a relationship with Binh and Xuyen. When asked by two leaders to create favorable conditions for Mai, this group disbursed the loan without completing the procedures for collateral.
