“I have consulted Honda Vision for a long time, but recently, intending to buy a car, the price quote is too high. Honda Vision usually has a price range of more than 30 million VND, but now the dealer quotes to more than 40 million VND, making me quite surprised, almost equal to Honda Lead. Not only users are disadvantaged when they have to buy cars at high prices, but the state also loses a tax revenue. The reason is because the agent’s VAT invoice price is equal to the manufacturer’s proposed price, while the difference is a separate revenue, without invoices and documents.

According to regulations, the registration fee for motorbikes is paid on the basis that the chargeable price is the value of the vehicle written on the VAT invoice.

Thus, the price to calculate the registration fee will be recorded on the VAT invoice, and the difference will be an amount that the agent automatically “pockets”.

Therefore, each individual should be alert to choose the right product for them, don’t always run after brands or tastes. This is not only the first time, but this has been a long process. At the same time, an increase in price compared to the listed price or the price on the invoice will lead to a loss of state budget revenue.”.

When asked about the fine,lawyer Diep Nang Binh said:”According to the provisions of Clause 6, Article 4 of the Law on Prices 2012; price listing means production by organizations or individuals; business public announcements by appropriate forms; be clear and not confusing to customers about the purchase price; selling prices of goods and services in Vietnam Dong.

The listing of prices is done by printing, pasting and writing prices on the board; on paper or on the packaging of the goods; or in other forms at the place of transaction or the place where goods are offered for sale. There are many essential items that will have to be listed such as listing prices of dairy products, listing prices of drugs, etc.

In many cases the list price is displayed as a price list; can be printed on product packaging; mount underneath products or hang a long list of different products; and specify the price of each of those products. Listed prices must be clearly stated, not confusing to buyers.

Pursuant to the provisions of Article 12 of Decree No. 109/2013/ND-CP dated September 24, 2013 of the Government stipulating penalties for administrative violations in the field of price, charge, fee and invoice management, Violations against regulations on publicizing information on prices of goods and services shall be handled as follows:

A warning shall be imposed for one of the following acts:

a) Failing to post up the prices of goods and services at the places where the prices must be posted according to the provisions of law;

b) Posting prices that are not in accordance with regulations or clearly cause confusion for customers.

A fine ranging from VND 300,000 to VND 500,000 shall be imposed for the act specified in Clause 1 of this Article committing the violation for the second time or more.

A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for selling goods or services at a higher price than the listed prices of goods and services determined by organizations or individuals that are not specified in Clause 5 of this Article.

A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for failing to disclose information about prices of goods or services in another form as prescribed by law other than by listing prices for goods or services. services on the List of goods and services priced by the State; List of goods and services subject to price stabilization, price declaration.

A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for selling goods or services at a higher price than the listed prices of goods and services on the List of price stabilization, goods and services on the List of restricted business or trading. conditional business.

A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed for failing to disclose the Price Stabilization Fund at the request of a competent state agency.

Remedy: Forced to return to the customer the amount collected higher than the listed price for the violation specified in Clauses 3 and 5 of this Article, in case the customer cannot be identified to return. then remit into the state budget.

In addition, according to the provisions of Article 13 of Decree 109/2013/ND-CP, acts of unreasonable increase or decrease in prices of goods and services shall be handled as follows:

A fine ranging from VND 1,000,000 to VND 5,000,000 shall be imposed if the goods or services are sold with a total value of up to VND 50,000,000, for one of the following acts of price increase:

a) Increase the selling price of goods and services higher than the price declared or registered with the competent state management agency as prescribed by law;

b) increase the price according to the price stated in the registration form or the price declaration document with the competent state management agency, but the competent state agency has a written request for explanation of the registered or declared price. or make a written request to suspend the application of the new price and re-register and re-declare the price.

A fine of between VND 5,000,000 and 10,000,000 shall be imposed for violations specified in Clause 1 of this Article if the goods or services have a total value of between over VND 50,000,000 and VND 100,000,000.

A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for violations specified in Clause 1 of this Article if the goods or services have a total value of over VND 100,000,000 to VND 200,000,000.

A fine ranging from VND 20,000,000 to VND 40,000,000 shall be imposed for the violations specified in Clause 1 of this Article if the goods or services have a total value of between over VND 200,000,000 and VND 500,000,000.

A fine ranging from VND 40,000,000 to VND 60,000,000 shall be imposed for violations specified in Clause 1 of this Article if the goods or services have a total value of over VND 500,000,000.

A fine ranging from VND 25,000,000 to VND 55,000,000 shall be imposed for unreasonable increase or decrease in prices of goods or services when examining price-forming factors at the request of the Prime Minister, Ministers, and heads of agencies. ministerial-level, chairperson of the People’s Committee of the province.

Remedial measures: Forcibly remit into the State budget the amount of profit from administrative violations for the acts specified in this Article.

It can be seen that it is unacceptable behavior to arbitrarily push the price of motorbikes of the Honda Revenue dealer system higher than the proposed price of Honda Vietnam.

Deliberately selling at a higher price, colluding to push the price of motorbikes higher or accidentally evading VAT in motorbike trading activities should be seriously handled by the focused authorities to protect the interests of consumers. and avoid causing tax loss to the state budget.
