Deputy Prime Minister Le Van Thanh assigned the Ministry of Natural Resources and Environment and the ministries and branches to research and overcome inadequacies in land valuation in Ho Chi Minh City to have solutions.

This request was made by the Government leaders on the basis of recommendations from the People’s Committee of Ho Chi Minh City on solving difficulties and problems when determining land prices to calculate financial obligations on land and compensation and support. when the State recovers the land.

Previously, in the document proposing to the Prime Minister, the People’s Committee of Ho Chi Minh City asked the Government to approve the city to build and issue a land price adjustment coefficient in accordance with reality and submit it to the People’s Council for approval.

From there, the City People’s Committee will issue the coefficient to adjust the land price to calculate the land use fee and land lease for the zones and parcels of land, regardless of over or under VND 30 billion. That is, there will be no need to hire a consultant to determine the specific land price according to the valuation method.

Currently, Decree 44/2014 provides 5 methods of land price appraisal: direct comparison, deduction, income, surplus (with the land plot calculated according to the land price list valued at 30 billion VND or more). and land price adjustment coefficient if the land plot is under VND 30 billion.

Among the above 5 methods, land valuation according to the land price adjustment coefficient as the basis for collection of land use fees and rentals is considered by Ho Chi Minh City to fully reflect the value of the land use rights of the assessed land, the following factors: affect the specific land price of the project.

The procedures for determining the land rental unit price according to the methods of direct comparison, deduction, income, surplus… all increase unnecessary administrative procedures for investors, as well as cause difficulties. in the rotation of records, the time to determine the land price.

Moreover, when determining, appraising and deciding on land prices, it is still difficult to choose a consulting unit for planning land pricing, to collect information on the actual transaction price of real estate on the market.

In addition, there are currently no quantitative regulations on adjusting the difference between comparable properties and appraised properties, as well as specific guidance on forecasting and volatility of transfer and rental prices, and other factors. factors that form revenue and project development costs.

These factors make it difficult for localities to determine land prices, leading to many projects hanging in the localities. At the 10th session of the National Assembly Standing Committee held last week, when giving comments to report to the Government on thrift practices and combating waste, many members of the National Assembly Standing Committee were worried about the number of suspended projects. in more and more localities.

Commenting that suspended projects are the current bottleneck, Deputy State Auditor General Doan Anh Tho mentioned difficulties related to the legal system on land and the guidance of the Ministry of Natural Resources and Environment. He said that many localities encountered difficulties in determining land prices and no one dared to sign the land price plan.

“There are localities that rely on audits to determine, but the auditors cannot give an opinion on how close the land price is to the market price and standard. The reason is the current methods of determining land prices. then the input factors are dynamic”, Mr. Tho said.

Therefore, the leader of the State Audit said that it is necessary to amend the legal regulations and the guidelines for determining land prices, otherwise this will be a bottleneck. In addition, he also suggested that the ministries and branches study the problem of determining the land allocation plan, because there is no standard, if the way is still the same as today.
