Husband who stabbed to death while rescuing wife from kidnappers sentenced to 1 year

On April 26, the People’s Court of Vinh Long province sentenced defendant Tran Ngoai Giao (32 years old, living in An Hiep hamlet, Long An commune, Long Ho district) to one year in prison for the crime of “Murder in an agitated state of mind.” strong”.

At the same time, the jury sentenced defendant Vo Thi Kim Chi (55 years old, mother-in-law of defendant Giao) to 3 years in prison; Nguyen Thanh Nhut (22 years old, son of Chi) 2 years in prison.

Defendants Nguyen Anh Vinh (27 years old), Nguyen Van Tien (31 years old), Tran Van Dung (31 years old, living in Nam Dinh) and Duong Van Tien (33 years old) were both sentenced to 3.5 years in prison for the crime of ” Arresting people illegally”.

According to the indictment, in 2020, defendant Giao married Ms. Vo Thi Thuy Hang (31 years old, daughter of Ms. Chi), both opened a coffee shop in Long Ho district, Vinh Long province. This marriage was opposed by Mrs. Chi, so she did not attend her daughter’s wedding.

Before getting married, Hang often sent money to support Ms. Chi. However, since moving from Ho Chi Minh City to Vinh Long, Ms. Hang no longer provides money for her mother.

Because she missed her child and thought that Hang was “bewitched” by her husband, she gave all her assets to the accused Giao, on November 14, 2020, Ms. Chi gave Tran Le Van Thinh (30 years old, in Dong Nai province) 10 million VND to go to Vinh Long to arrest Hang and bring it back to her.

Defendant Thinh invited Nguyen Van Tien, Duong Van Tien, Dung, Vinh and Nhut to go with him. Around 10 am on November 15, 2020, Vinh drove a 7-seat car carrying Thinh, Duong Van Tien, Nguyen Van Tien, Dung, and Nhut hired a taxi to lead the way to the cafe where the accused Giao and Hang were trading.

On the way, Thinh took pepper spray, electric whip and weapon to give to his accomplices.

At the cafe, Thinh sprayed pepper spray on Hang’s face, then pulled her out. Hang protested, shouting “robber, kidnap”, Dung ran from outside to help Thinh pull the victim to the car. At that time, Nguyen Van Tien sprayed pepper spray into the shop and around, preventing others from rescuing the victim. And Duong Van Tien, holding an electric whip, stood at the door of the shop, supporting his friends.

At this time, defendant Tran Ngoai Giao was behind the coconut garden, heard his wife’s cry for help, and ran in. Seeing that his wife was kidnapped and taken to the car, defendant Giao held a metal coconut tree and broke the car’s window.

While rescuing his wife, defendant Giao stabbed Thinh to death, Dung and Vinh were injured. After committing the crime, Giao surrendered to the police. Defendant Giao was charged with murder in a highly agitated mental state under Clause 1, Article 125 of the Penal Code.

The jury found that defendant Giao wanted to save his wife from kidnapping and took the victim’s life.
