Pursuant to the 2012 Law on Handling of Administrative Violations, the time to keep a driving license is 7 days from the date of custody, but it can be extended but must not exceed 30 days when the case has many complicated circumstances and further verification is required. The seizure of driving license must be made in 2 minutes, each party keeps 1 copy.

Article 78 of the 2012 Law on Handling of Administrative Violations on fine payment procedures stipulates:

Within 10 days after receiving the sanctioning decision, the sanctioned individual or organization must pay the fine at the State Treasury or into the State Treasury’s account recorded in the sanctioning decision. except for cases where fines specified in Clauses 2 and 3 of this Article have already been paid.

If the above time limit is exceeded, the sanctioning decision will be enforced, and for each day of late payment, the violating individual or organization must pay an additional 0.05% of the total unpaid fine.

In remote, border and mountainous areas where travel is difficult, the sanctioned individuals or organizations may pay fines to the person with sanctioning competence.

Persons with sanctioning competence shall collect fines on the spot and pay them at the State Treasury or into the State Treasury’s account within 7 days from the date of fine collection.

In case of sanctioning at sea or outside working hours, the person with sanctioning competence may collect the fine directly and pay it at the State Treasury or into the State Treasury’s account within 2 working days. from the date of arrival to shore or the date of fine collection…”.

If the temporary detention period expires but the violator still does not pay a fine to get the driving license back, the competent authority will handle the material evidences according to Article 17, Decree No. 115/2013/ND/CP:

– Announced at least twice on mass media;

– Publicly posting at the headquarters of the license holder.

Within 30 days of public announcement, if the violator comes to pay a fine to get his driving license back, he/she must pay an additional amount of late payment fine (0.05% of the total unpaid fine for each day of late payment).

Within 30 days from the date of the last notice, if the violator still does not come to pay the fine and receive the driving license, the competent person will issue a decision to confiscate and destroy it according to regulations (Article 109 of the Law on Management and Use of Driving License). public property in 2017).

Do not come to pay the fine to get the license that has been detained

If the violator does not come to get the driving license on time, overdue and intentionally drives the vehicle, he will be fined as if he did not have a driving license. Specific fines are as follows:

– A fine ranging from VND 10,000,000 to VND 12,000,000 shall be imposed on car drivers (Clause 11, Article 2, Decree 123/2021/ND-CP).

– A fine of from 1,000,000 to 2,000,000 VND for motorbikes.

– A fine of between VND 4,000,000 and 5,000,000 shall be imposed on drivers of motorcycles with a cylinder capacity of 175cm3 or more.

If the vehicle driver continues to commit a new violation, a new violation record will be made, one of the remaining papers will be temporarily seized or the vehicle will be impounded.
