Clause 1 and Point a, Clause 2, Article 26, Article 27 of the Law on Social Insurance 2014 stipulate that if an employee falls ill normally, he/she will be entitled to 75% of the salary on which social insurance premiums are based in the preceding month before leaving.

In case the employee is sick for a long time and has to take leave for more than 180 days, if he has paid social insurance premiums for less than 15 years, he will be entitled to 50% of the salary on which social insurance premiums are based. If paying from full 15 years to less than 30 years, employees will enjoy 55% of the salary on which social insurance premiums are based, and if paying for full 30 years or more, employees will enjoy 65% ​​of the salary on which social insurance premiums are based.

Maternity pay

As for maternity benefits, employees will have 3 amounts to receive: allowance for one-time childbirth, benefits calculated according to the monthly salary on which social insurance premiums are based, and post-natal care and health rehabilitation.

Article 38 of the Law on Social Insurance stipulates: “Female employees who give birth to children are entitled to a one-time allowance for each child equal to two times the base salary in the month of childbirth. In case of childbirth but only the father participates in social insurance, the father is entitled to receive social insurance benefits. a one-time allowance equal to 02 times the base salary in the month of birth for each child.”

The current base salary is 1.49 million VND/month. Therefore, the one-time allowance for each child is 2,980,000 VND.

According to Article 39 of the Law on Social Insurance, the maternity allowance of female employees who give birth each month is equal to 100% of the average monthly salary on which social insurance premiums are based in the 6 months before taking leave to enjoy the maternity regime.

Clause 3, Article 41 of the Law on Social Insurance in 2014 stipulates that one day after giving birth, the convalescence and health rehabilitation allowance is equal to 30% of the base salary. That is, with a base salary of 1.49 million VND/month, the employee’s salary for convalescence and health rehabilitation after childbirth is 447,000 VND/day.

Pension

The monthly pension is calculated by multiplying the rate of monthly pension enjoyment by the average monthly salary on which social insurance premiums are based.

For male employees, if they pay full 20 years of social insurance, they will get 45%, then, for each additional year of paying social insurance, an additional 2% will be calculated. The maximum monthly pension benefit rate is 75%.

For female employees, if they pay full 15 years of social insurance, they will get 45%, after that, for each additional year of paying social insurance, an additional 2% will be calculated. The maximum rate (%) of monthly pension is 75%.

According to the provisions of Clause 1, Article 66 of the Law on Social Insurance 2014, when the employee dies, the person taking care of the funeral will receive a funeral allowance. The funeral allowance is equal to 10 times the base salary in the month the employee dies, ie 14.9 million VND.

Clause 1, Article 68 of the Law on Social Insurance 2014 stipulates that the monthly survivorship allowance for each relative is equal to 50% of the base salary. In case the relative does not have someone to directly take care of him, the monthly survivorship allowance is equal to 70% of the base salary.

Currently, the monthly survivorship allowance for each relative is equal to 50% x 1,490,000 VND/month = 745,000 VND/month, for relatives without direct caretaker is 70% x 1,490,000 VND/month = 1,043,000 VND/month.

Occupational accidents, occupational diseases

If eligible for occupational accident benefits, employees will enjoy the following benefits:

– 1.5 months’ salary if there is a decrease of 5% to 10% of working capacity, then for every 1% increase, 0.4 months of salary will be added if there is a decrease in working capacity from 11% to 80 %;

– 30 months’ salary for employees whose working capacity is reduced by 81% or more or for dead employees’ relatives.
