According to the previous Decree 100, a house project with a scale of over 10 hectares in urban areas of grade 3 and above must set aside 20% of the land fund in the project to arrange social housing. For projects under 10 hectares, the investor may choose to perform the social housing obligation by land fund, house fund or in cash.

Decree 49 re-promulgates regulations, commercial house projects with scale of 2ha or more in special urban areas, grade 1; For projects of 5 hectares or more in grade 2 and 3 urban centers, 20% of the land fund must be allocated for social housing.

According to Mr. Tran Quoc Dung – Deputy General Director of Hung Thinh Land, the above regulations on social housing obligations are making it difficult for investors and indirectly increasing house prices.

Mr. Dung gives an example, a project in Thu Duc city has only 2ha. While the investor must compensate the land at a high price, the land amount deducted for the social housing land fund is calculated according to the State unit price. This rather large difference will cause commercial house prices to be pushed up.

Deputy General Director of Hung Thinh Land suggested that with land plots created by enterprises themselves, investors should be allowed to choose a plan to perform social housing obligations by arranging land fund other suitable places to develop social housing or pay in cash, regardless of size.

Another problem in the development of social housing is the problem zoning. Mr. Le Huu Nghia – Director of Le Thanh Trading – Construction Company Limited said that according to current regulations, social housing projects can increase the land use coefficient by 1.5 times.

According to Mr. Nghia, for the planned land area, the land use coefficient is 4. If developing a social housing project, the land use coefficient will be 6. However, in reality, the land use coefficient in planning is still 4, so the Departments and professional branches cannot submit. Not to mention, increasing the land use coefficient without increasing the height and population is very difficult for businesses to deploy.

In addition, Mr. Nghia said that when doing social housing, the investor can spend 20% of the apartment area or land fund for commercial sale. However, the profit is then calculated for the whole project, so it is considered that the investor is not entitled to this part.

Regarding the regulation of land fund for social housing, Mr. Le Hoang Chau – Chairman of Ho Chi Minh City Real Estate Association said that, from the previous decree until Decree 49 was issued, all projects in the downtown area of ​​​​Ho Chi Minh City. HCM has not yet implemented this regulation.

Mr. Chau cited a project in Thu Thiem new urban area. After deducting expenses, compensation for site clearance and incentives, the price per square meter of social housing in this project ranges from 30 to 40 million VND/m2. At this price, it is difficult for low-income people to buy.

In the face of problems regarding confirmation of fulfillment of obligations on social housing in residential and urban development projects in the area, recently Chairman of Ho Chi Minh City People’s Committee Phan Van Mai chaired a meeting with representatives of departments, relevant and directed industry.

For residential housing projects with a scale of less than 10 hectares implemented according to Decree 100, if the document of the competent authority shows the form of implementation of the social housing obligation, the investor must comply;

For projects where the document has not shown or clearly shows the form of social housing obligation, the Department of Construction must work with the investor of each project to agree on one of three forms (land fund, house fund or money). ) perform.

For residential projects with a size of 2 hectares or more, implemented after the effective date of Decree 49, when submitting to the People’s Committee of Ho Chi Minh City for approval of the investment policy, the Department of Planning and Investment must clearly define the form. implementation of social housing obligations.

The People’s Committee of Ho Chi Minh City agreed that the confirmation of the investor’s fulfillment of the obligation on social housing, whether in the form of land fund allocation at the project or house fund allocation, must be shown in the handover minutes by the department or specialized sector.

In case of payment, in the process of determining the land price for the investor to implement financial obligationsThe Department of Natural Resources and Environment must assume the prime responsibility for, and coordinate with relevant units in, formulating a land price plan, submitting it to the City Land Price Appraisal Council for appraisal and then submitting it to the City People’s Committee for approval.

In the land price plan, it is necessary to separate the value of land use rights corresponding to the area of ​​HOME land and the value of land use rights corresponding to the area of ​​social housing land.
