Proposal to investigate the crime of “Murder” with Nguyen Kim Trung Thai
On the afternoon of May 5, lawyer Tran Thi Ngoc Nu – The President of the Bar Association – Ho Chi Minh City Children’s Rights Protection Association sent an application petition the City People’s Procuracy to change the crime against Nguyen Kim Trung Thai (37 years old, living in District 1).
Accordingly, lawyer Ngoc Nu proposed to change the crime of Nguyen Kim Trung Thai – the biological father of an 8-year-old girl, from tormenting others to murder.
Previously, on May 4, the People’s Procuracy of Ho Chi Minh City issued an indictment and prosecuted it before the People’s Court of Ho Chi Minh City to try Nguyen Vo Quynh Trang (27 years old, from Gia Lai) about Crime of Murder and Torture; and Nguyen Kim Trung Thai on charges of Torturing others and Concealing crimes.
After receiving the indictment, female lawyer petitioned the People’s Procuracy of Ho Chi Minh City to consider the entire behavior of Nguyen Kim Trung Thai.
According to lawyer Ngoc Nu, the results of the autopsy have recorded injuries caused all over the body areas of baby A. With the body of an 8-year-old child, any area is a dangerous area. and the fact that the injuries caused the death of baby A. were not due to head injury.
The development of criminal behavior through recorded camera data, reflects the despicable and cruel criminal motives (beating the body of a naked child, kneeling, having hands and feet tied …), the purpose of the crime. The crime is intentionally causing injury (using dangerous weapons to beat, kick … in all areas of the child’s body, including the private area).
Crime takes place consecutively, many days, many times, even at night, performed with the same methods, tricks, and means, occurring at the same place. As a result of the offence, an 8-year-old child died.
The conclusion of the autopsy on January 20, 2022 noted that the injuries were the cause of death and the cause of death (old injuries) belonged to the cause-and-effect relationship.
Accordingly, female lawyer said that,The sequence of actions of Nguyen Kim Trung Thai has been determined: As the biological father of baby A. but joined with Trang to scold baby A., directly once used a dangerous weapon to beat baby A.; The times Trang beat baby A., Thai were seen directly or monitored through the camera.
Thai’s actions contributed to causing injury that “leads to death or is an additional factor leading to death”, is to help and promote Trang’s actions to cause injury and is the cause” cause death”.
Therefore, female lawyer said that Nguyen Kim Trung Thai must be jointly responsible for Nguyen Vo Quynh Trang’s misconduct for murder.
