Mr. Dinh Hoang Bao, Deputy Head of the Department of Planning and Land Registration – Sub-Department of Land Management (under the Department of Natural Resources and Environment of Binh Duong province) said that, through the inspection, the provincial Department of Natural Resources and Environment Binh Duong discovered many violations related to the field of environment and construction of C-Holdings Joint Stock Company at the C-River View project.

Specifically, C-Holdings Joint Stock Company did not register land changes for the land of the C-River View project, did not have an environmental impact assessment report, but organized the construction of the foundation of the C-River View project. project.

In particular, C-Holdings Joint Stock Company has organized illegal construction of works on land planted with perennial crops and non-agricultural production facilities.

From the above violations, Binh Duong Provincial People’s Committee has issued many decisions to sanction administrative violations against C-Holdings Joint Stock Company with a total amount of more than 600 million VND.

The Department of Natural Resources and Environment of Binh Duong province informed that C-Holdings Joint Stock Company has now complied with the payment of fines.

Before that, the Inspector of Binh Duong Department of Construction also twice issued a sanctioning decision with a total amount of 90 million VND for the illegal construction of C-River View.

As Dan Viet has reported in a series of articles, C-Holdings Joint Stock Company has repeatedly organized the illegal construction of C-River View apartment buildings in Phu Tho ward, Thu Dau Mot city, Binh Duong province.

After Dan Viet reflected, the Binh Duong Department of Construction got involved. On February 9, 2021, the Inspector of the Department of Construction issued a decision to impose a fine of VND 40 million on the project investor and requested that within 60 days, C-Holdings Joint Stock Company must carry out procedures to request the competent authority. competent to issue construction permits.

Notably, although it has not yet complied with the sanctioning decision of the Inspector of Binh Duong Department of Construction and has not completed the procedures for a construction permit, C-Holdings Joint Stock Company still continues to carry out construction work. Unauthorized construction works up to the 3rd floor.

Binh Duong Department of Construction confirmed that the behavior of C-Holdings Joint Stock Company violated the provisions of Point C, Clause 5, Article 15 of Decree 139 of the Government. The company’s recidivism is an aggravating circumstance.

Therefore, on January 14, 2022, the Inspector of Binh Duong Department of Construction continued to issue an administrative sanction decision with a fine of VND 50 million.

At the same time, it is required that within 60 days, C-Holdings Joint Stock Company must comply with the content of the Sanctioning Decision dated February 9, 2021 of the Inspector of Binh Duong Department of Construction.

On February 28, 2022, Binh Duong Provincial People’s Committee issued Decision No. 514/QD-UBND allowing C-Holdings Joint Stock Company to change the use purpose to non-agricultural land with an area of ​​3,317m2 to implement project C. – RiverView.

In which, the State allocates land with collection of land use levy with an area of ​​782m2, residential land use in urban areas. Land allocation without land use fee with an area of ​​2,534m2 to use for construction of waste dumps, energy works, amusement parks, traffic…

There is also a decision to change the purpose of land use in the form of registration of land changes with an area of ​​2,290m2. In which, land allocation with land use fee collection of 1,711m2 uses residential land in urban areas, the rest does not collect land use fees.

Binh Duong Provincial People’s Committee allows the project to be implemented until 2072, assigns departments to notify C-Holdings Joint Stock Company to pay land use fees, fees and charges as prescribed. At the same time, grant the land use right certificate when this enterprise fulfills its financial obligations.

Thus, after more than a year of C-Holdings Joint Stock Company illegally organizing the construction of apartment buildings, up to now, this business has only been allowed to change the land use purpose by the People’s Committee of Binh Duong province, the first step. during project implementation.
