It is used to issue a decision to enforce the deduction of money from an account for one account or multiple accounts to ensure the full collection of taxes, fines, and late payment interest.

Next, the State Treasury and credit institutions are responsible for carrying out the procedures for deducting and transferring the coercive’s money to the state budget revenue account opened at the state treasury. State treasuries and credit institutions will immediately notify tax authorities and the subject of coercion upon the transfer.

If the balance in the deposit accounts of Dream Republic Joint Stock Company and Sheen Mega Joint Stock Company is less than the amount that the two companies are forced to pay, the money must still be deducted and transferred to the account of the state budget. The extraction does not require the consent of the subject to be coerced. All other transactions of these two companies still take place normally.

After 180 days, if these two companies still have not paid enough money to the budget, the People’s Committee of Ho Chi Minh City will make a decision to cancel the auction winning result.

Specifically, in April, these two businesses will pay 15% of the total amount, the months of May, June, July, August will pay 17% and September 2022 will pay the rest.

However, when the Tax Department of Ho Chi Minh City exchanged opinions with other departments, they all said that it should be based on the contract signed previously between the business and the People’s Committee of Ho Chi Minh City. Specifically, the maximum period is 180 days (at the latest on July 6), otherwise the business will lose the deposit.

Currently, the tax authorities are still calculating the late payment interest at 0.03%/day. The calculation of late payment for the first installment has been applied since February 6, and from April 7, enterprises will be charged an additional amount of late payment for the second installment. Currently, the late payment amount these two businesses have to pay is more than 2, 3 billion VND/day.
