This Circular applies to the following 4 groups of subjects:

1) Cadres, civil servants and public employees arrange salary according to high-level expert’s salary table, professional salary tables, perform and serve working in state agencies from the central government to communes and wards, towns and in public service units.

2) Those who arrange their salaries according to the high-level expert’s salary table, the professional and professional salary table, and the performance and service prescribed by the State shall be decided by the competent authorities to come and work at projects and agencies. , an international organization located in Vietnam but still on the list of salaries paid by agencies and units.

3) Those who work under the labor contract regime in administrative agencies and public non-business units have an agreement in the labor contract to arrange salary according to Decree No. 204/2004/ND-CP on the salary regime. salaries for cadres, civil servants, public employees and the armed forces.

4) People who arrange salaries according to the salary table prescribed by the State and belong to the payroll quotas are funded by the state budget in associations with specific characteristics as prescribed in Decree No. 45/2010/ND-CP. on the organization, operation and management of the association and the Prime Minister’s Decision No. 68/2010/QD-TTg on defining associations with specific characteristics.

This Circular does not apply to cadres subject to salary classification according to the position salary table which has been paid according to the term; commune-level officials who are enjoying retirement or loss of working capacity allowance; Commune-level civil servants have not graduated from professional training.

2 standards for regular salary increase

The above groups of subjects who are eligible for a period of time to hold a rank in a rank or in a title and are assessed to meet 2 criteria during the period of holding the salary level will be entitled to a regular salary increase.

For cadres and civil servants, standard 1: being evaluated and graded by competent authorities at the level of task completion or higher; standard 2: not violate discipline in one of the forms of reprimand, warning, demotion or dismissal.

For officials and employees, standard 1: be assessed by competent authorities from the level of completing tasks or higher; standard 2: not violate discipline in one of the forms of reprimand, warning or dismissal.

In case of prolongation of regular salary increase calculation period

During the period of keeping the current salary level, if the cadres, civil servants, public employees and employees have notified or decided in writing of the competent authority that they do not complete their assigned annual tasks or are disciplined According to the law, one of the forms of reprimand, warning, demotion, or dismissal will have the time for calculating salary increase regularly compared with the prescribed time.

Lasting 12 months for the following cases: cadres are disciplined and dismissed; civil servants are subject to discipline demotion or dismissal; officials and employees are disciplined and dismissed.

Lasting 6 months for the following cases: cadres, civil servants and employees are disciplined, reprimanded or warned; officials are disciplined and warned; cadres, civil servants, public employees and employees are evaluated and graded by competent authorities at the level of failing to complete assigned tasks every year.

If there are 2 consecutive years of failure to complete the assigned tasks during the period of holding the rank, each year of not completing the assigned tasks will be extended for 6 months. Extended 3 months for officials who are disciplined and reprimanded.

The system of raising salary level ahead of time due to excellent performance in task performance

Accordingly, the above subjects have fully met the 2 criteria specified in this Circular and have made excellent achievements in performing the tasks recognized in writing by the competent authorities, if they have not yet ranked the last salary level in this Circular. rank or in a title and by December 31 of the year in which the salary level is considered to be raised before the deadline is 12 months or less, in order to receive a regular salary increase, the salary level increase will be considered for a maximum of 12 months before the deadline. than the specified time.

Time Time is not counted for consideration of regular salary increase

Personal leave without pay; The time spent working as an expert, studying, practicing, working or surveying at home and abroad exceeds the time limit decided by the competent authority; Period of work suspension, temporary detention, detention and other types of non-working time; The probationary period (including the case of receiving 100% of the salary of the civil servant rank or professional title of the probationary public employee); The time of the cadres, civil servants, public employees and employees deserting in the course of performing their active military service; Probation period for cadres, civil servants, public employees and employees who are sentenced to prison but given suspended sentences; in case the probationary period is less than the extended period of regular salary increase, it shall be calculated according to the extended period of regular salary increase; Time off from work until reaching retirement age according to current provisions of law.

Regular salary increase mode

Cadres, civil servants, public employees and employees who have not yet ranked the final salary level in the civil servant ranks (ranks), in the professional titles of public employees, the titles of senior experts and professional and professional titles in the industry. The court, the Procuracy (title) currently holding, may consider raising a regular salary level when meeting the conditions for holding a rank in the rank or title and meeting the criteria for a regular salary increase during the period of time. salary period.
