The Ministry of Finance continues to request Ho Chi Minh City to amend regulations on fee collection for seaport infrastructure

Recently, the Ministry of Finance has issued Official Letter No. 3978/BTC-CST to the People’s Committee of Ho Chi Minh City, which officially requests the People’s Committee of Ho Chi Minh City to report to the People’s Council of Ho Chi Minh City to amend Resolution No. 10/2020/ NQ-HDND promulgates the fee for using infrastructure works, public utility service works in the seaport border gate area in Ho Chi Minh City (toll fee for seaport infrastructure).

Accordingly, the Ministry of Finance received Official Letter No. 3206/UBND-KTNS dated March 31, 2022 of the People’s Committee of Dong Nai Province, and Official Letter No. 627/HQBD-GSQl dated March 29, 2022 of the Provincial Customs Department Binh Duong on the Scheme on collection of fees for the use of infrastructure works, public utility service works in the seaport border gate area in Ho Chi Minh City and Official Letter No. 05/BanIV dated 4/4/ 2022 by the Committee for Research and Development of the Private Economy, sent to the Prime Minister to report a number of inadequacies and negative impacts on business operations from the collection of fees for using seaport infrastructure in Ho Chi Minh City.

Regarding this issue, the Ministry of Finance has issued Official Letters No. 2681/BTC-CST dated March 17, Dispatch No. 6665/BTC-CST dated June 21, 2022, Dispatch No. 2784/BTC-CST dated June 21, 2022. March 25, 2022 to the People’s Committee of Ho Chi Minh City.

Accordingly, these official documents clearly state: “The regulation of fees for the difference between imported and exported goods that are declared open in Ho Chi Minh City and opened in other localities causes inequality. discrimination.

Article 8 of the Law on Fees and Charges stipulates that the fee levels are determined to basically cover costs, taking into account the State’s socio-economic development policies in each period, ensuring fairness, publicity, transparency and equality in the rights and obligations of citizens.

The Ministry of Finance proposed the Ho Chi Minh City People’s Committee to consider responding to the petitions of businesses and report to the Prime Minister on the reasonableness of Resolution No. 10/2020/NQ-HDND (especially the regulation on the level fee difference) and reviewed the content of the Vietnam – Cambodia Waterway Transport Agreement to adjust the fee collection Resolution to ensure fairness, publicity, transparency, equality of rights and obligations, and compliance with regulations.

Therefore, in Official Dispatch No. 3978/BTC-CST, the Ministry of Finance requested the People’s Committee of Ho Chi Minh City to urgently report to the City People’s Council to amend Resolution No. 10/2020/NQ-HDND to create conditions for businesses and the economy to recover and develop, ensuring fairness, publicity, transparency, equality of rights and obligations, and compliance with the Law on Fees and Charges.
