New regulations in Hanoi when many households sharing a land plot are acquired

Chairman of the Hanoi People’s Committee Chu Ngoc Anh has just signed and promulgated Decision No. 20 amending and supplementing Clause 2, Article 26 of the regulations promulgated together with Decision No. 10 dated March 29, 2017 of the Hanoi People’s Committee promulgating regulations. Accordingly, the City People’s Committee amends Clause 2, Article 26 to stipulate the eligible cases for compensation with land. Specifically: In the case of a multi-generational household, many couples living together on the same piece of residential land, which are recovered, are eligible to separate into separate households according to the provisions of the law on residence or have more than one household. households that share the right to use a piece of residential land recallthen each household is allocated a resettlement rate equal to the local residential land allocation quota and does not exceed the recovered residential land area (the allocated land area includes the compensation land area according to the regulations of law). referred to in Article 7 of this regulation).

In case each household is assigned a resettlement rate equal to the minimum residential land allocation quota in the locality, which exceeds the recovered residential land area, the resettlement land area in excess of the recovered residential land area must be charged a fee. use land at the land price when allocating resettlement land multiplied by the adjustment coefficient K according to the provisions of Point b, Clause 3, Article 7 of this Regulation.
