‘Can’t penalize people who run red lights to give way to ambulances’

I would like to give a personal opinion that I hope everyone can see from a legal perspective on giving way to ambulances. Thereby, we hope that each person can quickly make the most harmonious decision when facing a similar situation.

First, let’s clarify the concept of “running a red light”. According to the law, when the light is red and the vehicle crosses the stop line, it is not obeying the light signal, called a red light for short. Thus, regardless of the purpose, the fact that we advance over the stop line, more or less, but the light is red means a violation or a violation.

However, not all violations are penalized. Specifically, according to Article 11, Clause 1 of the Law on Handling of Administrative Violations (XLVPHC) 2012, if violations occur in “urgent situations”, they will not be administratively handled.

What is the emergency situation? This Law states: “A situation of an individual or organization that wants to avoid a real danger that threatens the interests of the State or organization, their own or other people’s legitimate rights and interests, and cannot be saved. the other is to cause less harm than to prevent it”.

Thus, there are 3 factors that need to be clarified: legitimate interests, losses and no other way.

Legitimate interests here can be property, health, life… their own or that of others. The ambulance in the back is the health and life of others.

Damage is smaller than damage to be prevented: running a red light to give way must take place safely, without obstruction, collision with vehicles traveling in the direction of green light, without loss of life and property. .. then of course the damage will be smaller.

There is no other way: for example, instead of running a red light, we can climb onto the sidewalk, for example, this is obviously difficult to say, depending on the situation, depending on the judgment, reflexes and observation ability of each person. People.

Therefore, if we safely cross a red light to give way to an ambulance, it can be applied in the case of an “emergency situation” so as not to be penalized.
