Performing a contract with the Ministry of Health, from February to April 2006, Cuu Long Pharmaceutical Company imported 520 kg of Oseltamivir material for $9.1 million from Mambo Company (Singapore). Cuu Long Pharmaceutical Company then paid 5.25 million USD to Mambo Company, the remaining more than 3.84 million USD was delayed for 6 months from the date of receipt.

Notably, during the investigation process, the investigating agency asked banks and land registration offices in Hanoi and Ho Chi Minh City to review and suspend transactions related to accounts, savings books, real estate and real estate. of defendant Cao Minh Quang.

Due to the decrease in the price of raw materials, the General Director of Cuu Long Pharmaceutical at that time, Mr. Luong Van Hoa, directed his subordinates to propose Mambo Company to reduce the price by 3.84 million USD (equivalent to more than 61 billion VND). This amount was then added by Mr. Hoa to the capital of production and business activities to increase revenue for the company and did not report to the Ministry of Health.

“Shut up” trick $3.8 million

At the end of 2006, using the excuse that the drug production was a state secret, and information was not disclosed, Mr. Hoa directed his subordinates to complete the paperwork to keep the books out of the books at 3.84 million USD. When he was discovered by the Drug Administration of the Ministry of Health, asked to report on the payment for raw materials, Mr. Hoa continued to direct his subordinates to go through procedures around the clock to validate the payment records.

After a long inspection, in June 2014, the file was transferred to the Ministry of Public Security for investigation.

The investigating agency determined that the Ministry of Health did not request in writing Cuu Long Pharmaceutical Company to report and provide documents related to the implementation of the price reduction negotiation clause in the contract to purchase medicinal ingredients.

In particular, former Deputy Minister Cao Minh Quang was determined to hold the position of Head of the Steering Committee dealing with Tamiflu and Oseltamivir drugs, so he was responsible for checking the arising problems.

In conclusion, Mr. Quang checked and discovered that Cuu Long Pharmaceutical Company “hidden” USD 3.8 million, but did not direct further inspection and clarification.
