Thus, Decree No. 100 in 2015 of the Government and Circular No. 20 in 2016 of the Ministry of Construction do not stipulate restrictions on who can buy, rent, or lease-purchase floor areas of social housing projects for sale. , lease, hire-purchase at commercial business prices. Besides, according to the provisions of point c, clause 1, article 6 of Circular No. 20, 2016 of the Ministry of Construction guiding the implementation of some contents of Decree No. 100 2015 of the Government on the development and management of social housing, for the commercial business part of the social housing project specified at points b and c, clause 1, Article 9 of Decree No. 100 (specified in the construction project Social housing approved by a competent authority), investors may sell, lease, or lease-purchase at commercial business prices (within the price structure including land use fees) to subjects who need to offset the cost of social housing investment, contribute to reduce the selling price, rental price, rental price of social housing and reduce the management and operation costs of the project’s social housing.

However, according to the provisions of Clause 2, Article 159 of the Law on Housing 2014; Clause 1, Article 75 of Decree No. 99 dated October 20, 2015 of the Government detailing and guiding the implementation of a number of articles of the Law on Housing and Clause 2, Article 75 of Decree No. 99 (amended and supplemented at Clause 22, Article 1 of Decree No. 30/2021/ND-CP), foreign organizations may only buy, lease-purchase commercial houses (apartments, separate houses) in investment projects on housing construction. in commerce, except for areas where national defense and security are ensured as prescribed by law.

“Contrasting with the above regulations, foreign organizations are not allowed to buy and own houses for commercial houses in social housing projects”, the Ministry of Construction affirmed.

Stop allowing foreign experts to “underground” at social housing projects

Bac Giang Provincial People’s Committee has also requested the Management Board of Provincial Industrial Parks to strengthen the management of foreign workers in industrial zones according to regulations; monitor and urge the movement of in-house experts out of the project’s buildings no later than April 20, 2022, and at the same time assist in finding new places and locations for experts to stay.
