Regarding solutions to solve problems and problems in the issuance of residential LURCs, Mr. Tan said, for cases where the rights of land users have been exercised, the rights to the entire land parcel have been exercised. not considered, re-acknowledged. Having exercised the right to a part of the land plot, the remaining area in the original certificate will be considered for re-recognition according to regulations.

For cases where the land user’s rights have not been exercised, consider re-recognizing the residential land area in accordance with the provisions of the 2013 Land Law. For the case where the land user from December 18, 1980 to before July 1, 2004 and the land user is holding one of the papers on land use rights specified in Article 100 of the Land Law and Article 18, Decree No. 43/2014/ND-CP and Clause 16, Article 2, Decree No. 01/2017/ND-CP where the document clearly states the residential land area, the residential land area shall be determined according to that document. If the residential land area is not specified in that document, the residential land area shall be determined according to Clause 2, Article 8 of Decision No. 15/2020/QD-UBND dated November 5, 2020 of the People’s Committee of Quang Nam province.

In case the land user does not have one of the papers specified in Clauses 1, 2 and 3, Article 100 of the 2013 Land Law, re-recognize the residential land area according to Decision No. 15/2020 /QD-UBND dated November 5, 2020 of the People’s Committee of Quang Nam province.
