Proposals on the location, scale and nature of the planning project of the investors have been approved by the state management agency. This led to many detailed urban projects being approved before the Hoa Binh city master plan (approved).

These can be mentioned cases of Yen Quang high-class urban area, Trung Muong urban area, Phu Dat high-class housing area, Phuc Tien ecological urban area, green Hoa Binh ecological urban area… approved for detailed planning before the two sides of the route. Hoa Lac – Hoa Binh road was formed (planned).

The project to adjust the general planning of Hoa Binh city to 2035 is invested by the Department of Construction, and the consulting unit for adjustment (planning) is the National Institute of Urban and Rural Planning. Appraisal agency (Department of Construction) with a planning area of ​​more than 14,440ha, population by 2015 is about 300,000 people.

According to the conclusion of the Inspector of the Ministry of Construction, the time for formulation and adjustment of the general planning of Hoa Binh city is 16 months behind, violating the regulations on time for making urban general planning for provincial cities (in Decree No. 37 in 2010 of the Government on the formulation, appraisal and approval of urban planning).

In addition to the errors in making the adjustment scheme of the general planning of Hoa Binh city to 2035 by the relevant units, the inspection conclusions of the Ministry of Construction also pointed out a series of errors in the adjustment of a number of projects. Urban areas in the area.

Specifically, the detailed planning project of 1/500 scale of a new urban area in Thinh Lang ward, Hoa Binh city has increased the land area to build villas and townhouses in violation of regulations. The Inspector of the Ministry of Construction indicated that in plot 21, according to the general planning of the city, it is determined to build a financial, trade and service center at regional and provincial levels. However, according to the detailed planning, the project has converted 34,133m2 into residential land for the construction of villas and townhouses, inconsistent with the orientation of the approved general planning.

Detailed planning of 1/500 of this new urban area has a residential land area exceeding 80,450m2 compared with the residential land area approved in the general planning of Hoa Binh city to 2035.

In addition, at the Trung Minh new urban area project, the detailed planning of 1/500 scale is invested by the consortium of New House Trading Joint Stock Company – Vietnam Financial Investment Group Joint Stock Company as an investor. residential land area exceeds 78,800m2 compared with the residential land area according to the approved master plan adjustment project of Hoa Binh city to 2035.

Massively doing projects to “make room”?

Referring to the group of interests related to land, former Deputy Minister of Natural Resources and Environment Dang Hung Vo said that the fact that investors massively build projects to “clear up space” is a common situation happening all over the world. water, not only in Hoa Binh. Mr. Vo said that most of the projects are implemented contrary to the spirit of the 2013 Land Law. Accordingly, the law clearly stipulates that the State recovers land from the people and then auctions or allocates land for lease to increase the price. land management.

The Land Law 2013 has been implemented for 10 years, but recently, very few project owners have participated in land auctions. “In my opinion, Hoa Binh province, especially Quang Tien commune, approved 35 projects, including 5 golf projects, but most of them are behind schedule, contrary to the regulations, not in accordance with the planning.” Mr. Vo said.

According to Mr. Vo, meanwhile, projects that are behind schedule all have clear deadlines for the state to recover land and money on land. “In my opinion, there are 3 places responsible for wrongdoing, one is the management commune, the People’s Committee of Hoa Binh city and the People’s Committee of Hoa Binh province for the project. We have to apply the criminal framework to solve this problem,” Mr. Vo said.

According to Mr. Vo, is the provincial government wrong, but where are other authorities, such as the Ministry of Natural Resources and Environment? “Some authorities violate the principles, find ways to circumvent and combine interest groups between local governments and investors, leaving the interests of the people and the country out,” said Mr. Vo.

And Mr. Nguyen Ba Ngai, General Secretary of the Vietnam Forest Owners Association, said that according to Directive 13 of the Central Executive Committee (2017), the conversion of natural forest land was prevented and banned, except for programs and projects of a specific nature. nation. This regulation is clear, even the provincial level is not allowed to transfer that forest land from 1 ha or more. The current state does not allow the transfer, anyone who moves natural forest land out of the goal of serving forestry is wrong.

Mr. Ngai emphasized that production forests are converted but must follow the local planning. “There is no local planning, no one is allowed to convert forest land. The policy mechanism of the State is very tight. The conversion of forest land to service land that does not create material value for the locality must be further restricted,” said Mr. Ngai.

According to Mr. Ngai, since the golf courses in Quang Tien commune, Hoa Binh City People’s Committee is licensed, but the origin of the land is the investors who have transferred, bought and collected forest land before. “To solve this problem, we have to check, even inspect, what kind of forest land is it? Is this land in the planning? The purchase and sale at any time, before or after the regulations of the Government. However, it is clear that land management or forest management is first and foremost the responsibility of the Chairman of the Provincial People’s Committee…”, Mr. Ngai said.

“We have adequate regulations on forestry, the question is, is the locality doing it right? When must the document be reviewed before the provincial People’s Committee converts the purpose of forest land to a golf course?”, Mr. Ngai emphasized.
