In addition, in order to prevent and handle the act of buying and selling social insurance books, in the application for the development of the Law on Social Insurance (amended), the Ministry of Labor, War Invalids and Social Affairs also proposes to add prohibited acts to the act of buying and selling. social insurance books in any form.
According to the Department of Social Insurance (MOLISA), this revision of the Law on Social Insurance has many notable points, especially the regulation on reducing the time of participating in social insurance to enjoy pension.
The minimum number of years of paying social insurance premiums to enjoy the pension is reduced to at least 15 years instead of at least 20 years of paying social insurance premiums or more.
The current Law on Social Insurance stipulates the minimum period of participation in social insurance to have the opportunity to enjoy the full 20-year pension scheme. This leads to many people not accumulating enough years of social insurance contributions to enjoy pensions. Meanwhile, many countries now stipulate a 10-year period of participation in social insurance to be eligible for pension, although the pension level may be low, it is still better than switching to old age pension or social pension. Therefore, the Ministry of Labour, Invalids and Social Affairs is calculating a proposal to amend the conditions for enjoying the retirement regime in the direction of gradually reducing the number of years of payment of minimum social insurance contributions from 20 years to 15 years, with the benefit calculated accordingly.
Regarding the above proposal, the Ministry of Justice (the agency that examines the bill before submitting it to the Government) believes that this solution will contribute to increasing the number of people after retirement age who are entitled to pensions, in line with the spirit of the Government. spirit, the goal of Resolution 28 of the Party Central Committee on social insurance policies.
Because if the minimum participation period is reduced to 15 years, then 10 years will be a beneficial rule for the people. In addition, when this regulation is implemented, it will encourage people to stay in the social insurance system and wait for enough time to enjoy their pension instead of receiving a lump-sum social insurance allowance as at present.
On the other hand, this proposed change also creates conditions for middle-aged freelance workers aged 40-50 to still participate in voluntary social insurance and receive pensions when they are old enough and have enough time to participate in social insurance.
