During the implementation process, the project still had errors in land acquisition, planning and approval, compensation payment, site clearance support and land handover.

Specifically, the investor, the People’s Committee of Bac Ninh City, assigned the City Construction Project Management Board to prepare compensation and support plans for site clearance, but this agency did not have the function and task of organizing the project. carry out site clearance.

Bac Ninh City People’s Committee, Bac Ninh City Compensation and Site Clearance Council, Bac Ninh City Construction Project Management Board and Hap Linh Ward People’s Committee made mistakes in preparing and approving urban wastewater support funds. Government regulations on compensation, support and resettlement when the State recovers land. On the other hand, the funding to support urban wastewater is not regulated by the decision of the People’s Committee of Bac Ninh Province and has not been approved by the Chairman of the Provincial People’s Committee.

The compensation and site clearance council of Bac Ninh city, the construction project management board of Bac Ninh city and the People’s Committee of Hap Linh ward did not prepare a compensation plan to support the relocation of the 110kV power line running through the project. But making a plan and paying 30% support for representatives of the Women’s Union and Farmers’ Union with an amount of more than 180 million VND is not the right target.

Propaganda and mobilization of households to receive compensation and support for site clearance to implement the project of Bac Ninh City Compensation and Clearance Council, Bac Ninh City Construction Project Management Board and People’s Committee Hap Linh ward has not been effective, leading to the application of coercion to 10 households and individuals (to date, households have not received compensation and support money).

In organizing the auction of land use rights, the Bac Ninh Provincial Property Auction Service Center does not conduct field inspections for the auctioned land according to regulations. Currently, within the project boundary, there is still a power line and a 110kV high voltage pole running through the project and has not been moved.

On the side of the auction winning unit, Duc Phat Kinh Bac Joint Stock Company, was late in paying land use fees to the state budget and was charged a late payment fee of more than VND 8.4 billion. Not only that, during the inspection, this enterprise provided incomplete records and documents of the stage of construction investment implementation.

The enterprise has not yet prepared an additional dossier for the housing part, which must be built with the rough part and completed on the outside, and submitted to the competent authority for approval according to regulations; The construction procedures and documents have not been completed yet to organize the implementation of the investment project approved by the Provincial People’s Committee.

Although not yet qualified to start construction as prescribed, they still leveled a part of the project area (about 30%) and constructed the foundation of the main road, from outside the national highway 38 to make roads in and out. project.

Regarding the transfer of land use rights, at the time of inspection, Duc Phat Kinh Bac had not been granted a land use right certificate and had not been confirmed by the state management agency to be eligible for land use right transfer. .

Clarifying individual and collective wrongdoing

According to the inspection agency, the People’s Committee of Bac Ninh City is responsible for approving the project plan that partially overlaps the power grid safety corridor of the 110kV power line.

The People’s Committee of Bac Ninh City is also responsible when assigning the City Construction Project Management Board to make a plan for compensation and support for site clearance that is not in accordance with regulations.
