For the same crime, defendant Lam Chi Quang (former General Director of VEAM) was sentenced to 10 – 11 years in prison, Vu Tu Cong (former Chief Accountant of VEAM) was recommended 8 – 9 years in prison, Dao Quoc Viet (former) Director of Vetranco) was recommended 13-14 years in prison; The remaining 5 defendants were recommended from 24 months in prison but given a suspended sentence of up to 18 years in prison.

For the crime of “lack of responsibility, causing serious consequences”, the Procuracy asked the court to sentence Mr. Nguyen Van Khoi (66 years old, former head of the Supervisory Board, member of the VEAM’s Board of Members) 20 – 30 months in prison, but allowed get suspended sentence

Regarding civil liability, the defendants must jointly compensate for the amount of damage in the case, which is determined to be more than 380 billion VND.

According to a representative of the prosecution agency, the defendants, who are assigned important responsibilities and manage large state assets, are highly qualified and responsible, fully aware of their behavior, but still lack responsibility, for wrongdoing.

The defendants’ acts caused serious losses to the State’s property, caused great harm to the economy and the general development process of the country, and affected the interests of employees and shareholders. In which, defendant Tran Ngoc Ha has the main role, committing the crime many times.

The Procuracy said that defendant Ha directly caused more than 130 billion VND in damage. However, in court, the accused has not sincerely confessed to the crime, so it is necessary to apply a strict punishment.

Previously, when questioned, defendant Tran Ngoc Ha denied all accusations of the Procuracy.

Mr. Ha said that the guarantee for Vetranco (a subsidiary of VEAM) to borrow money from the bank, causing a loss of nearly 76 billion VND, was decided by the General Director. Mr. Ha was then the Chairman of the Board of Directors, subject to “investment” activities, while business activities, borrowing… were under the General Director’s authority.

Also at the interrogation, Mr. Ha denied further allegations of wrongdoing in the investment and production of two medium-sized four-wheel tractors and right-hand drive cars in contravention of regulations, causing damage to the State 66 billion copper.

The defendant asserted that the investment was made properly because every year, the Board of Directors issues production and business plans, sales and exports of products shown in numbers. The General Director must actively implement.

Explaining about the loss of nearly 10 billion dong when making a deposit for a commercial agreement, not an investment, Mr. Ha said that this money has not been lost because the agreement does not specify a time limit.

“The investigative agency does not reflect the true nature of the problem, the accusation is not true to me. I myself am an active person, passionate about work, if it is beneficial to do it, even the next generation does not do things. then the factory does not exist”, argued the former VEAM Chairman.

According to the Procuracy, from 2011 to 2013, defendant Vu Tu Cong (VEAM Chief Accountant) advised, proposed, and drafted documents to submit to Lam Chi Quang to sign 5 bank payment guarantee certificates for Vetranco (the company). subsidiary of VEAM) borrowed a total of 193 billion VND.

By the time of debt repayment, Vetranco’s side did not have enough money, so VEAM was forced by banks or had to pay debts on behalf of Vetranco for a total amount of nearly 76 billion VND.

Mr. Tran Ngoc Ha (Chairman of the Board of Directors of VEAM for the period 2011-2014) is accused of, with his powers and responsibilities, knowing that the payment guarantee for Vetranco is a violation of the loan guarantee ratio according to the regulations. law. However, the accused still created conditions for his subordinates to make guarantees and loans in contravention of regulations.

Regarding the investment project to produce mid-sized four-wheel tractors and the signing and implementation of two VEAM-ZIBO Agreements on investment and development of right-hand drive cars, Mr. Tran Ngoc Ha is said to have arbitrarily decided cooperated and signed contracts with foreign companies, resulting in a loss of more than 66 billion VND.

From the above violations, the Procuracy said that Mr. Ha played the main role, causing the State to lose hundreds of billions of dong.
