During the trial of the Family and Juvenile Court (HCMC People’s Court) in mid-May, Ms. Binh repeatedly turned to look at her youngest son Huynh Van Quynh, 19 years old, sitting next to her. Eyes filled with tears, the accused sometimes looked back to Vinh – his eldest son. “She’s probably still angry with me, she hasn’t been in the camp for two years to visit her mother,” she said.

Standing outside the courtroom, Vinh was small, wearing a cap that almost covered his face, avoiding all eyes. He attended the court as a representative of the victim – Mr. Quang, his father, but to ask the court for leniency for his mother and younger brother.

In an application to the court before the trial, Vinh presented his family situation in Thai My commune, Cu Chi district, always lacking in affection. “Mother was tortured both physically and mentally by her father. My brother and I often witnessed the scene where my mother was beaten and cursed by her father. Being repressed for too long, my mother acted irrationally. My brother also because loved his mother and was still young, so he acted without thinking,” he wrote in the application.

Vinh said that twice, her mother was beaten by her father and had to be hospitalized. He is also the one who often has to stand up to intervene. Due to a difficult life, in order to have money to feed his children, study and cover his living expenses, his mother had to do all kinds of jobs every day such as housekeepers, workers, whoever hired to do it. And Quynh is very docile and loves her mother. After 9th grade, he switched to vocational training and then went to work part-time to help his mother make a living.

Meanwhile, Mr. Quang does not have a stable job and earns a living by reading fortune-telling. He was often drunk, every time he drank, he beat and cursed his wife. The house is rarely peaceful. Many times the commune officials had to come to the conciliation.

According to the indictment, in 2019, Binh and Quang divorced but still lived in the same house. They still quarrel often, Mr. Quang repeatedly threatened to sell the house without dividing the money to his ex-wife and chased all 3 mother and daughter away. On the evening of August 14, 2020, Mr. Quang came home drunk, cursed again and said he would sell the house. An angry Binh said to Quynh (at this time 17 years old): “Your father sold the house and left his mother and daughter to live in a motel room, I risked killing him, what can you help me with”. The youngest son nodded.

Being beaten by her ex-husband with a broom, Binh knocked him down, and Quynh held his father’s leg so that his mother could strangle him. Vinh ran to beg but Binh only stopped when her ex-husband died.

“I hate my mother, but I love her more. During this time, I was not allowed to go to the prison to visit my mother and sister, only send money,” Vinh explained the reason for not visiting her mother for the past two years.

Waiting for the children to grow up a bit, she was strong enough to file for divorce to free herself and her children. Because of the difficult life, the mother and daughter had no place to live, so Binh had to accept to live in the same house with her ex-husband.

“He reported that he had sold his house, received a deposit of 100 million dong and would kick the mother and daughter out into the street. Sometimes he brought all of the defendant’s belongings to the front door… Because the defendant was too angry, he did not check. control his behavior”, Binh said about the cause of the crime.

Disagreeing, the chairman said: “The victim was partly at fault but not to the extent that the defendant had to take his life. It was the defendant who dragged his son into the prison.” Binh turned to look at Quynh, choking.

Presenting in court, Vinh recalled that his mother had been abused for a long time, and his younger brother, because he loved his mother and was impulsive, committed the crime. He asked the jury to let his mother and younger brother enjoy the lightest sentence possible.

The defense lawyer for mother and daughter Binh analyzed the cause of the crime stemming from the victim’s fault. Mr. Quang has cursed, insulted his honor and dignity and beaten Binh for many years, now he has sold his house and kicked the mother and daughter out of the house. These actions have caused mental inhibition to the defendant.

“The victim’s chain of guilty behavior leads to the defendant committing the crime in a state of high mental agitation, loss of reason, loss of control, leading to a negative choice. Defendant Quynh and the victim are both It is a family tragedy”, the lawyer stated, and asked the court to consider giving the mother and daughter a light sentence.

According to the jury, Mr. Quang was at fault, but not to the extent that Binh had to take his life, and Quynh’s crime was also the fault of this mother. Therefore, the court considered that it was necessary to apply a strict sentence to Binh, and sentenced him to 11 years in prison for the crime Killing. Quynh committed the crime as a juvenile and was sentenced to 9 years in prison.

The trial ended, Binh hugged his youngest son and sobbed. Quynh beckoned Vinh to come closer, instructing: “I will be transferred to Bo La prison in two weeks. Second brother, remember to go to the post office to send money to your mother.”

Vinh stared blankly at the figure of his mother and brother being led to the prison car.
