These are 2 out of 7 defendants in the case of “Appropriation of property” related to cremation service activities led by Nguyen Xuan Duong who have appealed. In which, Nguyen Xuan Duong appealed because he was unjustly accused and did not commit the crime of “appropriating property” as prosecuted; Defendant Nguyen Khac Nin appealed to reduce the punishment.

Before that, in November 2021, the People’s Court of Thai Binh province tried the first instance and sentenced defendant Duong to 15 years in prison; Nguyen Khac Nin 12 years in prison.

After that, Nguyen Xuan Duong and Nguyen Khac Nin appealed to reduce the punishment. In addition, defendant Duong said that the jury needed to clarify some details in the cremation service activities that he participated in operating.

At the morning appeal session on May 24, all 25 victims who were owners of funeral service establishments in Thai Binh province were absent.

At the end of the trial, the Trial Panel did not accept the whole content of the appeal and upheld the first-instance judgments against the two defendants because they thought that the defendants’ actions were very serious, making people in the locality worse. confusion. In which, defendant Nguyen Xuan Duong was sentenced to 15 years in prison; defendant Nguyen Khac Nin 12 years in prison.

According to the indictment, from 2017 to April 2020, Duong claimed to be the Chairman of Thai Binh Provincial Funeral Association, taking advantage of the name Duong Duong Co., Ltd., led by his wife, Nguyen Thi Duong, to forcing funeral service establishments in the area to operate and pay money at the request of “Nhue” Duong.

Defendant Duong himself promulgated the operating regulations of the funeral association of Thai Binh province, divided the area of ​​operation and forced funeral service businesses to comply.

Duong’s abusive behavior was helped by his juniors Ninh Duc Loi, Nguyen Khac Nin, and Bui Manh Tien.

Accordingly, if any funeral parlor did not comply, Duong let his juniors block the hearse, cut the area, threaten and assault with many cunning tricks.

Afraid of Duong, 25 funeral facilities in Thai Binh province had to agree to text messages about cremation to his group. For each cremation, the subject collects 500,000 VND.

At first, Ninh Duc Loi played the role of right-hand man, handling many jobs on behalf of Duong and receiving payment for shift reports and statistics.

However, at the beginning of December 2019, the subject nicknamed Cuong “Son La” told Duong that Loi Bao Ca was dishonest and asked to be replaced. Road agreed.

Nguyen Thi Duong, Duong’s wife helped Duong “Nhue” to sign contracts on principles and regulations on funeral service activities set out by Duong.

Duong also directly received more than 100 million dong for reporting the shift and gave it to her husband.

By these tricks, the group of husband and wife Nguyen Xuan Duong and their juniors appropriated from 25 victims a total amount of nearly 2.5 billion VND.

Regarding this case, at the first-instance trial on November 18, 2021, the Provincial People’s Court peaceful sentenced the couple Nguyen Xuan Duong and 5 other juniors as accomplices to a total sentence of 81 years in prison for the crime of “extorting property” under Article 170 of the Penal Code 2015.
