Recently, the Employment Department, the Ministry of Labour, Invalids and Social Affairs has issued an official document guiding the implementation of the Prime Minister’s Decision 08/2022, in response to requests for guidance on solving a number of problems related to rent support. for employees of the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City.

Specifically, according to the provisions of Clause 1, Article 3 of Decision 08, only enterprises, cooperatives and business households with business registration are eligible to apply.

Regarding beneficiaries of policy support, according to the provisions of Point a, Clause 3, Article 8 of Decree 145/2020, the total time the employee has actually worked for the employer, including the time of maternity leave, leave sickness benefits for 14 or more working days in a month (not participating in social insurance but still on the list of participating in compulsory social insurance of the social insurance agency).

Therefore, employees who take leave to enjoy maternity benefits or take sick leave are eligible for rent support if they fully meet the conditions specified in Decision 08.

Regarding the payment method and certification by the social insurance agency, according to the provisions of Clauses 3 and 4, Article 7 of Decision 08, for currently working employees, enterprises can send a list of employees to request the social insurance agency to confirm the lump sum. two or three months. Particularly for employees who return to the labor market, enterprises must send a list of requests for monthly rent support to the social insurance agency before the 15th of each month.

Previously, the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City sent an urgent dispatch requesting the Ministry of Labour, Invalids and Social Affairs to guide and remove some problems during the implementation of Decision 08.

Specifically, related to the concept of “Employers”, Decision 08 stipulates: “Employers are enterprises, cooperatives, business households with business registration, and employ or employ employees. according to the agreement”.

This can be understood that only enterprises, cooperatives, business households with business registration can offer to support rent for employees. In other types, employees are not eligible for support.

Regarding beneficiaries and conditions, according to Decision 08, employees entitled to rent support must be participating in compulsory social insurance in the month preceding the time the enterprise makes a list of employees requesting support.

However, a number of cases that are receiving social insurance benefits and are not required to pay social insurance contributions, including employees who take leave to receive maternity benefits, and employees who take sick leave will not be eligible for the salary policy.
