One of the basic reasons for the above situation mentioned by Minister Hung is that there are still many shortcomings in regulations and policies in the current Law on Domestic Violence Prevention and Control. The administrative procedures and conditions for handling domestic violence cases in the current Law are quite complicated.

The current law does not specify who must leave the house when domestic violence occurs, while in most cases of domestic violence, the person who must leave the house is the victim of the violence.

Meanwhile, the measure of fines in administrative sanctions against domestic violence offenders has not been effective. In many cases, the person experiencing domestic violence is the one who pays the fine and the fine is taken from the family’s common property. This makes the person experiencing domestic violence not want to report the act of domestic violence in the next time and also does not help with deterrence and education for the perpetrator.

To overcome the above shortcomings, the draft law supplements provisions on reporting and denouncing domestic violence; handling and verifying reports and denunciations about domestic violence cases; using assistive devices to identify violations of the law on domestic violence prevention and control; measures to prevent, protect and support victims of domestic violence.

In particular, the draft regulation on banning domestic violence offenders from contacting victims according to the decision of the Chairman of the commune-level People’s Committee. When applying the decision to ban contact, the person experiencing domestic violence has the right to choose a place to stay during the time of no contact.

Persons banned from contact must keep a distance from the person experiencing domestic violence during the time of application of the contact ban measure from 50m or more, in case there is a barrier to ensure safety for the person experiencing domestic violence, minimum distance does not apply.
